AIR FORCE DISCHARGE REVIEW BOARD DECISIONAL RATIONALE		 CASE NUMBER

FD-2014-00537

GENERAL: The applicant appeals for an upgrade to an Honorable discharge.

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.

The attached brief contains available pe1tinent data on the applicant and the factors leading to the discharge.

FINDING: The Board denies the upgrade of the discharge.

ISSUE: The applicant received a General discharge for Misconduct - Drug Abuse and Loss of Professional Status.

The Air Force Discharge Review Board, under its responsibility to examine the propriety and equity of an Applicant's discharge, is authorized to change the characterization of service and the reason for discharge if such change is warranted. In reviewi ng discharges, the Board presumes regularity in the conduct of governmenta l affairs unless there is substantial credible evidence to rebut the presumption, to include evidence submitted by the applicant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pe1tinent standards of equity and prop1iety. The applicant's record of service included one A1ticle 15. His misconduct included being absent from duty without authorization, engagi ng in off-duty employment without receiving authorization and with intent to deceive, maki ng false official statements on two separate occasions.

The applicant contends his discharge was inequitable due to it bei ng an isolated incident in 20 months of service. The applicant did not submit any documentation to support his claim of inequity. An Honorable discharge is appropriate when a member's service has generally met USA F standards or when service is otherwise so meritorious that any other characteri zation would be inappropriate. A General discharge is appropriate when significant negat i ve aspects of conduct or performance of duty outweigh the positive
aspects. The Board concluded that the applicant engaged in such an extensi ve course of misconduct , that the characterization of the discharge recei ved by the applicant was found to be appropriate.

CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive requirements of the discharge regulation and was within the discretion of the discharge authority and the applicant was provided full administrative due process.

rn view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for upgrade of discharge and determines the discharge should remain unchanged.
