GENERAL: The applicant appeals for upgrade of discharge to Honorable and to change the re-enlistment code.

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.

The attached brief contains ava ilable pert inent data on the applicant and the factors leading to the discharge.

FINDI NG : The Board denies the upgrade of the discharge and the change of the re-enlistment code.

ISSUE: The applicant recei ved a General discharge for Misconduct -Drug Abuse

The Air Force Discharge Review Board, under its responsibi lity to examine the prop1iety and equity of an Applicant's discharge, is authorized to change the characterization of service and the reason for discharge if such change is warranted. In reviewi ng discharges, the Board presumes regularity in the conduct of governmenta l affairs unless there is substantial credible evidence to rebut the presumpt ion, to include evidence submi tted by the applicant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pertinent standards of equity and propriety. The applicant's record of service included one Article 15 for wrongful use of oxycodone and one Letter of Counsel ing for failure to go to a mandatory appointment.

Applicant contends discharge was inequitable because it was based on an isolated incident in 36 months of service. The Board found no evidence to ind icate that in the applicant's two years of service he was unaware of the A i r Force policy of zero tolerance to drug use. The Board found the seriousness of drug abuse affords the commander the authority to pursue admin istrative discharge to uphold good order and discipli ne,
regard less of whether or not the member has a relatively clear record. The Board found the negative aspects of the willful miscond uct outweighed the positive aspects of the applicant's performance and concluded that the discharge was appropriate. A discharge is upgraded only if the applicant and the Board can establish that an ineq ui ty or impropriety took place at the time of discharge. After a thorough review of the record, the Board found no evidence to justify an upgrade of the discharge or change to the re-enlistment code.

CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the proced ural and substanti ve req uirements of the discharge regulation and was within the discretion of the discharge authority and the applicant was provided full administrative due process.

In view of the foregoing find ings, the Board fu1iher concludes that there exists no legal or equitabl e basis for upgrade of discharge and detennines the discharge should remain unchanged.
