GENERAL: The applicant appeals for upgrade of discharge to Honorable.
The applicant was offered a personal appearance before the Discharge Review Board (ORB) but declined and requests that the review be completed based on the available service record.
The attached brief contains available pertinent data on the applicant and the factors leading to the discharge. FIN DI NG: The Board denies the upgrade of the discharge.
ISSUE: The applicant received a General discharge for Miscond uct - Commission of a serious offense.
The Air Force Discharge Review Board, under its responsibili ty to examine the propriety and equity of an Applicant's discharge, is authorized to change the characterization of service and the reason for discharge if such change is warranted. I n reviewing discharges, the Board presumes regularity in the conduct of governmental affa i rs unless there is substantial credible evidence to rebut the presumption, to include evidence submitted by the applicant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pertinent standards of equity and propriety. The Applicanf s record of service incl uded one A11icle 1 5 for control of a POV while intoxicated and one Letter of Reprimand for being an-ested by civi l ian authorities for driving whi le intoxicated.
Issue I . The appl icant contends that the discharge was based on an isolated incident over 9 years, 11 months of service. He also claims that his misconduct was a resu lt of alcohol dependence. The DRB recognized the fact that the applicant had served for almost 10 years prior to the discharge being initiated, but concluded the applicanf s miscond uct outwei ghed the positive aspects of his time i n the Air Force. The Board noted the applican t was entitled to request an administrative discharge board, but waived his right to do so. They found the seriousness of the misconduct offset the positi ve aspects of the applicant's duty performance. The Board concluded the characteriza tion of discharge was appropriate. I lowever, u pon review of the records, the DRS did consider the diagnosis of alcohol dependence a basis for a change to the narrative reason for discharge.
Issue 2. The appl icant cited his desire to recei ve the G.l. Bill benefi ts as justification for upgrade. The DRS noted that when the applicant applied for these benefits, he signed a statement (DD Form 2366, on March 27, 2003) t hat he u nderstood he must receive an Honorable discharge to recei ve future educational entitlements. The Board was sympathetic to the impact from the loss of these benefits to the applicant however, this is not a matter of inequi ty or impropriety which would warrant an upgrade
CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the procedura l and substanti ve requirements of the discharge regulation, was within the discretion of the discharge authority. and that the applicant was provided full administrat ive due process.
I n view of the foregoi ng find ings, the Board concludes that the characterization for discharge is appropiiate however , the reason for discharge is more accurately descri bed as Secretarial Authority under the provisions of Title I 0, USC 1 553.
