GENERAL: The appl icant appeals for upgrade of discharge to Honorable.
The applicant was offered a personal appearance before the Discharge Review Board (ORB) but declined and requests that the review be completed based on the available service record.
The attached brief contains available pe1iinent data on the appl icant and the factors lead ing to the discharge.
FINDING: The Board denies the upgrade of the discharge.
ISSUE: The appl icant received a General discharge for Misconduct - Minor Discipl inary Infractions
The Air Force Discharge Review Board, under i ts responsibili ty to examine the propriety and equity of an Appl icant's discharge, is authorized to change the characterization of service and the reason for discharge if such change is warran ted. ln reviewi ng discharges, the Board presumes regulari ty in the conduct of governmental affairs unless there is substantial cred ible evidence to rebut the presumpt ion, to include evidence submitted by the applicant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pertinent standards of equity and propriety. The Applicanf s record of service incl uded: four Letters of Reprimand for weari ng the rank of A I C whi le still an AB, fai l ing to remove Honor Grad uate ribbon and refused to obey a student leader; failing to show for the thi rd PH A and fai l ing to cancel or reschedule it within 24 hours of the sched uled time; fa iling to refrain from reviewi ng computeri zed personal med ical information on another ind ividual assigned to the same duty section: with intent to deceive had a LT sign a loan forn1 that was previously advised that no one
111 command woul d sign based on the excessive interest rates and l ied to a CO; one Letter of Admonishment for failing to go to Commander's Call; one Record of Counseling for fa i ling to show for cycle test for the second t ime; four Letters of Counsel ing for failing to go to duty on time, failing to have sufficient funds i n bank accoun t to cover checks that were wri tten to another a irman, fai l i ng to go to duty (x2) on time and took an extended dinner.
The member made no contention of impropriety or ineq ui ty. A discharge is upgraded only if the applica nt and the Board can establ ish that an ineq ui ty or im propriety took place at the t ime of discharge. After a thorough review of the records, the Board found no evidence to warrant an upgrade of the discharge characterization.
CONCLUSION: The Discharge Review Board concl udes that the discharge was consisten t with the proced ura l and substanti ve requi rements of the discharge regulation, was withi n the discretion of the discharge authori ty, and that the applicant was provided full admin istrati ve due process.
I n view of the foregoi ng find ings, the Board further concludes that there exists no legal or equitable basis for upgrade of discharge and determi nes the discharge should remai n u nchanged.
