AIR FORCE DISCHARGE REVIEW BOARD DECISIONAL RATIONALE		 CASE NUMBER


FD-2014-00428

GENERAL: The applicant appeals for upgrade of discharge to General.

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.

FINDING: The Board grants the requested relief.

ISSUE: The applicant received a Under Other Than Honorable Conditions discharge for Misconduct - Drug Abuse.

The Air Force Discharge Review Board, under its responsibi lity to examine the propriety and equity of an Applicant's discharge, is authorized to change the characterization of service and the reason for discharge if such change is warranted. In reviewing discharges, the Board presumes regulari ty in the conduct of governmental affairs unless there is substantial credible evidence to rebut the presumption, to include evidence submitted by the applicant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pertinent standards of equity and propriety. The Appl icant"s record of service included one A1iicle 15 for use of marijuana.

The applicant contends that his discharge was inequitable because it was based on a broken agreement between him and his leadership. He states that the agreement for his discharge was to accept an Article 15, followed by a General discharge Under Honorable Cond itions. The Board did not find evidence of an agreement for a General discharge; however, after a thorough review of the record , the OR B determined there is sufficient evidence to support his claim of inequity. Although the Board does not condone the applicant's misconduct, the Board finds the discharge to be harsh and warrants an upgrade to General.

CONCLUSION: The Discharge Review Board concl udes that the discharge was inconsistent with the procedural and substantive requirements of the discharge regulation and finds the applicant was not provided fu ll administrati ve due process.

In view of the foregoing findi ngs, the Board concludes that the characterization for the discharge is more accurately described as Under Honorable Conditions General, per provisions of Title I 0, USC I 553.
