GENERAL: The applicant appeals for upgrade of discharge to Honorable and to change the reason and authority for the discharge.
The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.
The attached brief conta ins available pertinent data on the applicant and the factors lead ing to the discharge.
FINDING: The Board denies the upgrade of the discharge and change of reason and authority for discharge is denied .
The Board finds the applicant submitted no issues contesti ng the equity or propriety of the discharge, and after a thorough review of the record, the Board was unable to identify any that would justify a change of discharge.
ISSUE: The applicant received a General discharge for Misconduct - Minor Disciplinary Infractions
The Air Force Discharge Review Board, under i ts responsibility to examine the propriety and equity of an applicant's discharge, is authorized to change the characterization of service and the reason for.discharge if such change is wan-anted. In reviewi ng discharges, the Board presumes regulari ty in the conduct of governmenta l affairs unless there is substantial credible evidence to rebut the presumpt ion, to include evidence submitted by the applicant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pertinent standards of equity and propriety. ln order to adhere to Mental Health Amendments to I 0 USC 1553, a physician with specialized trai ning on men tal hea l th disorders was present for this board. The applicant 's record of service i ncluded two A rticle l 5s, one Letter of Reprimand, and one Letter of Counseling, and a vacation of suspended non jud icial pu nish ment. Her misconduct i ncl uded fail ing to go to duty on time (2x), and maki ng a false officia l statement with the intent to deceive (2x).
The applicant stated in her application that she graduated with her Bachelor's Degree i n 2004 wi th a dual major in Social work and Psychology. She then recei ved a Master 's Degree in Science of Social Work i n 2005. She added that she is a producti ve member of her communi ty, and has worked with chi ldren with special need s for many years. The DRB was pleased to see that the applicant was doing well and has overcome her difficult past. However, no i nequ i ty or im propriety i n her discharge was suggested or found in the course of the heari ng. The Board concluded the misconduct of the applicant appropria tel y characterized her term of service. A discharge is upgraded only if the applicant and the Board can establish that an inequity or impropriety took place at the time of discharge. After a thorough review of the record , the Board found no evidence to justify an upgrade of the discharge characterization or reason for the discharge.
CONCLUS ION : The Discharge Review Board concludes that the discharge was consistent with the procedura l and substantive req uirements of the discharge regulation, was within the discretion of the discharge authority, and that the applican t was provided full administrati ve due process.
In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for upgrade of discharge and detennines the discharge shou ld remain unchanged. |
