AIR FORCE DISCHARGE REVIEW BOARD DECISIONAL RATIONALE FD-2008-00498
GENERAL: The applicant appeals for upgrade of discharge to honorable, to change the reason and
authority for the discharge and to change the reenlistment code.
The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined
and requests that the review be completed based on the available service record. The attached brief contains
available pertinent data on the applicant and the factors Icading to the discharge.
FINDINGS: ‘The Board denics the upgrade of the discharge, change of reason and authority for discharge
and change of reenlistment code.
The Board finds that neither the evidence of record nor that provided by the applicant substantiates an
inequity or impropriety that would justify a change of discharge.
The record indicates the applicant received the following corrective action:
1. One (1) Article 15 for dishonorably failing to pay debt (Article 134-11, UCM)).
2. One (1) Letter of Reprimand for failing to pay debts.
3. One (1) Letter from Club noting account overdue by 90 days.
ISSUE:
Issue 1. Applicant contends financial inexperience, new marriage and bills not getting paid in his absence.
After review of the record, the Board concluded that there was insufficient evidence to evaluate the merits of
the applicant’s alleged mitigating factors. The Board found the Air Force acted in accordance with
established policies and that the discharge was procedurally proper and equitable and no change was
warranted.
Issue 2. Applicant contends post-service financial responsibility, working marriage as evidence of reform.
The Board was pleased to see that the applicant was doing well and has a good job. However, no inequity or
impropriety in his discharge was suggested or found in the course of the hearing. The Board concluded the
discharge was appropriate.
CONCLUSIONS: The Discharge Review Board concludes that the discharge was consistent with the
procedural and substantive requirements of the discharge regulation and was within the discretion of the
discharge authority and the applicant provided full administrative due process.
In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for
upgrade of discharge and determines the discharge should remain unchanged.
