APPLICANT REQUESTS THAT:
His records be corrected to include the Meritorious Service Medal
(MSM) on his DD Form 214.

APPLICANT CONTENDS THAT:
The MSM was omitted from his DD Form 214.
In support of his appeal, applicant submitted a copy of the
certificate and citation for the MSM and a copy of his DD Form 214,
Certificate of Release or Discharge from Active Duty.
Applicant's complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:
On 23 Jul 74, the applicant contracted his initial enlistment in the
Regular Air Force. He was progressively promoted to the grade of
master sergeant having assumed the grade effective and with a date of
rank of 13 Oct 93. He was honorably retired on 1 Nov 94.

AIR FORCE EVALUATION:
HQ AFPC/DPSIDR recommends denial. DPSIDR states the applicant
submitted what appears to be a valid citation and certificate for the
MSM; however, the special order that is required to validate the
citation and certificate was not provided. DPSIDR further states they
were unable to verify his entitlement to the MSM.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant 26
Sep 08, for review and comment within 30 days. As of this date, no
response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Sufficient relevant evidence has been presented to demonstrate
the existence of an error or an injustice. While the applicant was
unable to provide a copy of the orders approving the MSM, he was able
to provide a signed certificate and validated citation awarding the
MSM. Therefore, based on the evidence provided, it appears that he
did in fact receive the MSM upon his retirement from the Air Force.
In view of the above, we recommend that his records be corrected to
the extent indicated below.

THE BOARD DETERMINES THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT be corrected to show that he was awarded the
Meritorious Service Medal for outstanding service from 1 August 1989
to 31 October 1994.

Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to , be corrected to show he was awarded the Meritorious
Service Medal for outstanding service from 1 August 1989 to 31 October
1994.
