APPLICANT REQUESTS THAT:
He receive Special Selection Board (SSB) consideration by the Calendar
Year (CY) 2006 (06) Lieutenant Colonel (Lt Col) Central Selection
Board (CSB) with the inclusion of his Joint Service Commendation Medal
(JSCM) citation in his Officer Selection Record (OSR).

APPLICANT CONTENDS THAT:
A base level query indicated the medal was loaded in the system.
However, following his nonselection for promotion to Lt Col, he was
informed by an HQ AFPC counselor that his JSCM citation was missing
from his OSR.
In support of his request, the applicant provided a copy of an
Electronic mail (e-mail).
Applicant's complete submission, with an attachment, is attached at
Exhibit A.

STATEMENT OF FACTS:
The applicant is currently serving on active duty in the grade of
major (Maj).
The applicant was considered but not selected for promotion to the
grade of lieutenant colonel by the CY06A and CY06C lieutenant colonel
CSBs.

AIR FORCE EVALUATION:
AFPC/DPPPO recommends the requested relief be denied. AFPC/DPPPO
states the Military Personnel Flight Memorandum (MPFM) 05-39, dated 11
October 2005, sent to eligible officers meeting the CY06A board, the
instructions attached to the Officer Preselection Brief (OPB) clearly
instructed the officer to request a copy of their OSR from HQ
AFPC/PBR1 at least 60 days prior to the board, or contact the records
technician by telephone and go over the contents of their record. It
specifically instructed the officers to ensure their records contained
all awarded decoration citations. They further stated if the
applicant had followed the instructions of the MPFM, he would have
noted the missing citation and could have taken corrective action
prior to the convening of the board. It is the responsibility of the
servicemember to ensure the accuracy of his record prior to the board
convening date, not after he has been nonselected for promotion. The
applicant’s JSCM citation was filed in his OSR on 15 August 2006.
Although the applicant’s JSCM citation was not in his OSR when the
board convened, the board members knew of its existence as evidenced
by the entry in the decoration section of his OSB. Therefore, they
were able to factor it into the promotion selection process.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on
27 April 2007, for review and response within 30 days. As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of an error or an injustice. After thoroughly reviewing
the evidence of record, we are not persuaded that the applicant should
be provided consideration for promotion to the grade of lieutenant
colonel by a Special Selection Board for the Calendar Year 2006A
selection board. Although the applicant’s citation to the JSCM
citation was missing from his OSR when the board convened, it was
annotated in his OSB. Therefore, presumably the selection board knew
of its existence and factored it into their consideration.
Furthermore, servicemembers who are eligible to meet a promotion board
are instructed to request a copy of their OSR to ensure their records
contain all awarded decoration citations. The applicant states prior
to the board convening a base level inquiry indicated his decoration
was loaded into the system. The Board finds no evidence that he
exercised due diligence to ensure the data in his record was accurate
for presentation to the board. We are not persuaded by the evidence
before us that this omission was the sole cause for the applicant’s
non-selection to the grade of lieutenant colonel, nor are we persuaded
that the lack thereof significantly impacted his promotion
opportunity. In summary, we do not find applicant's assertions, in
and by themselves, sufficiently persuasive to override the rationale
provided by the Air Force. Therefore, we agree with the
recommendation of the Air Force and adopt the rationale expressed as
the basis for our conclusion that the applicant failed to sustain his
burden of establishing the existence of either an error or an
injustice warranting favorable action on these requests.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
