APPLICANT REQUESTS THAT:
He be provided Special Selection Board (SSB) consideration by the Calendar
Year 2006A (CY06A) Lieutenant Colonel Central Selection Board (CSB), with
inclusion of the Joint Service Commendation Medal (JSCM) in his Officer
Selection Record (OSR) and reflected on his Officer Selection Brief (OSB).

APPLICANT CONTENDS THAT:
All achievements for the award of the decoration were accomplished by
September 2005. The Joint Tactical Radio System program switched from the
Department of the Army to the Department of the Navy and this created
confusion for the approval chain. The Secretary of the Defense did not sign
the citation until 31 March 2006. Since this missing document may have
created a misconception about his performance, he requests consideration
for the upcoming Special Selection Board.
In support of his appeal, the applicant provided a copy of the citation and
the special order pertaining to the JSCM.

STATEMENT OF FACTS:
Information extracted from the Personnel Data System (PDS) indicates the
applicant is currently serving on active duty in the grade of major, having
been promoted to that grade on 1 June 2002. His Total Active Federal
Military Service Date (TAFMSD) is 3 January 1992.
The applicant has one nonselection for promotion to the grade of lieutenant
colonel by the CY06A.

AIR FORCE EVALUATION:
AFPC/DPPPO recommends denial and states the applicant's JSCM was processed
within the guidelines of AFI 36-2803, para 3.1. These guidelines state that
decoration recommendations are entered "into official channels within two
years and awarded within three years of the act, achievement, or service
performed." Furthermore, in accordance with published guidance, the
decoration award authority announces its final decision when approving an
award by publishing special orders. These orders serve as the source
document for updating the decoration in the Military Personnel Data System
(MilPDS). Because the order for this decoration was not published until 3
April 2006, the citation was not included in his OSR nor was it reflected
in any of our official personnel data systems when the board convened.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to applicant on 28 July
2006 for review and response. As of this date, no response has been
received by this office within 30 days.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice warranting approval of his request for the
Joint Service Commendation Medal (JSCM) to be accepted for file prior to
the CY06A Major Board convening date. In this respect, we note that, by
regulation, decoration recommendations are entered into official channels
within two years and awarded within three years of the act, achievement, or
service performed. Therefore, the JSCM was processed in a timely manner
and it did not exist at the time the CY06A board convened. Other than his
own assertions, we have seen no evidence by the applicant indicating that
his superiors intended or attempted to expedite the processing of the award
for the purpose of its consideration by the CY06A lieutenant colonel
selection board. Accordingly, in view of the above and in the absence of
evidence to the contrary, we find no basis to recommend granting relief.

The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
