His records be corrected to reflect he served in Vietnam.

APPLICANT CONTENDS THAT:
His DD Form 214 does not reflect service credit or ribbons for his service
in Vietnam. His TDY from Pope AFB was supposed to be credited and was not.
He has no TDY orders or permanent orders to back his claim; it has been
over 35 years. TDY orders were probably for Kadena, Okinawa then Nha Trang
and Laos.
He found he had not received credit when he applied for membership in the
Veterans of Foreign Wars (VFW) and was turned down.
In support of his request, applicant provides copies of Request and
Authorization for Permanent Change of Station Forms, and a personal
statement.

STATEMENT OF FACTS:
Applicant served on active duty in the Regular Air Force from 26 Oct 65
– 20 May 70. His DD Form 214 reflects he served 1 year, 11 months, and 19
days of Foreign Service, and that he was awarded the National Defense
Service Medal (NDSM), Good Conduct Medal (GCM), Small Arms Expert
Marksmanship Ribbon (SAEMR), and the Air Force Longevity Service Award
(AFLSA).
The Foreign Service Summary on AF Form 7 (Airman’s Military Record)
reflects he was assigned in Germany from 31 May 68 – 19 May 70.

AIR FORCE EVALUATION:
AFPC/DPAPP recommends denial. They state there are no documents in
applicant’s personnel records that verify any TDYs to Vietnam, and that
none of his Airman Performance Reports make any reference to a TDY to
Vietnam. Additionally, applicant indicates he has no documents of any kind
that could be used to verify a TDY to Vietnam.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 25 Aug 06, a copy of the Air Force evaluation was forwarded to the
applicant for review and comment within 30 days. As of this date, this
office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case; however, we agree
with the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for our conclusion that
the applicant has not been the victim of an error or injustice. Therefore,
in the absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.
4. The applicant's case is adequately documented and it has not been shown
that a personal appearance with or without counsel will materially add to
our understanding of the issue involved. Therefore, the request for a
hearing is not favorably considered.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
