APPLICANT REQUESTS THAT:

His records be corrected to reflect service credit for  two  temporary
duty (TDY) tours to Vietnam and the Good conduct Medal (GCM).

EXAMINER’S NOTE:  On 3 January 2007, a DD Form 215 was issued  to  add
the GCM.

APPLICANT CONTENDS THAT:

He was TDY in Vietnam in 1965 and 1966.

In support of his appeal, applicant submitted a statement.

Applicant's complete submission, with an attachment,  is  attached  at
Exhibit A.

STATEMENT OF FACTS:

The applicant enlisted in the Regular Air  Force  (RegAF)  on  5  July
1963, as an airman basic (AB) for a period of four years.

The applicant's personnel records reflect his overseas assignments  as
Zaragoza and Torrejon Spain.

The applicant was released honorably from active duty on  9 May  1967.
He served a total three years, ten months and five days of active duty
service.

HQ AFPC/DPAPP on 8 September  2006  requested  the  applicant  provide
documentation showing he was TDY to Vietnam.  The  applicant  did  not
respond.

On 19 December 2006, HQ AFPC/DPPPR informed  the  applicant  that  his
entitlement to GCM had been verified and his  DD  Form  214  would  be
updated.

AIR FORCE EVALUATION:

HQ AFPC/DPAPP recommends the requested relief be denied.   They  state
there is no documentation in the applicant’s records that  reflect  he
was TDY to Vietnam.  Furthermore, the applicant failed to respond to a
request to provide documentation in support of his request.

A complete copy of the evaluation is attached at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 3
November 2006, for review and response.  As of this date, no  response
has been received by this office.

Mr. W. H., Veteran of Foreign Wars Post 4203 provided a  letter  dated
23 November 2006, stating the applicant’s military service  started  3
July 1963 and he was released from active duty on 9 May 1967.

He further states the applicant  was  TDY  at  Torrejon  and  Zaragoza
Spain; however, it was during this period of time that  the  applicant
was TDY to Vietnam with the 307th E-Vac Squadron.

He further requests the  307th  personnel  unit  records  be  searched
regarding the applicant’s status during the time period  in  question.
He also suggests the applicant’s pay records be reviewed regarding the
applicant receiving flight and hazardous  duty  pay  during  the  time
period in question (Exhibit E).

On 27 December 2006, Mr. W. H., Veterans of  Foreign  Wars  Post  4203
provided a letter stating the 307th  Evacuation  Unit  was  under  the
command of the 19th Tactical Air Support Air Squadron (Exhibit F).

A copy of the Air Force evaluation was forwarded to the  applicant  on
19 January 2007, for  review  and  response.   As  of  this  date,  no
response has been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was not timely filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to demonstrate
the existence of an error or an injustice.   We  took  notice  of  the
applicant's complete submission in judging the  merits  of  the  case;
however, we agree with the opinion and the recommendation of  the  Air
Force and adopt its rationale as the basis for our conclusion that the
applicant has not been the victim of an error or an injustice.   There
is no documentation in the applicant's military records to  verify  he
was TDY to Vietnam.  Therefore, in the  absence  of  evidence  to  the
contrary, we find no compelling basis to recommend granting the relief
sought in this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
