APPLICANT REQUESTS THAT:
His records be corrected to show he served time in Vietnam.

APPLICANT CONTENDS THAT:
His six-week TDY (June-July 1965) to Bien Hoa Air Base, Vietnam, while
stationed in Japan, is not listed on his separation document (DD 214).
Without proof of Vietnam service, he cannot apply for service-connected
disability for diabetes Millitis Type II; presumed from herbicide exposure.
The TDY occurred 41 years ago and he no longer has copies of his orders.
No supporting documentation was submitted. The applicant's complete
submission is at Exhibit A.

STATEMENT OF FACTS:
On 30 September 1977, the applicant retired from active duty service and
was honorably discharged in the grade of senior master sergeant. He was
credited with 22 years and 1 month of total active service.
The applicant’s records indicate he was assigned duties in Japan Korea, and
Thailand.

AIR FORCE EVALUATION:
HQ AFPC/DPAPP recommends denial. DPAPP states there are no documents in
the applicant’s personnel record that verify any TDYs to Vietnam. None of
his Airman Performance Reports make any reference to a TDY to Vietnam. In
addition, the applicant indicates he has no documents that would verify his
TDY to Vietnam.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
In his response dated 19 Sep 06, the applicant provided a copy of an Air
Traffic Control Rating Record (Exhibit E).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice regarding his contentions that he served
time in Vietnam. However, after a thorough review of his submission and
the available evidence of record, we were unable to find evidence which
substantiates his claim. Although his military records show he was
stationed in Japan during the time in question, we found no documentation
that supports his contentions that he was temporarily assigned to Bein Hoa
Air Base, Vietnam for six weeks. In the absence of such evidence, his
request is not favorably considered.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of an error or injustice and that the application will only
be reconsidered upon the submission of newly discovered relevant evidence
not considered with this application.

DPAPP states a review of the applicants master personnel records and documentation submitted failed to substantiate Foreign Service time in Vietnam. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice.
