APPLICANT REQUESTS THAT:
She be granted Below-the-Zone (BTZ) Promotion Special Selection Board (SSB)
consideration by the CY06A (15 May 06) (P0606A) Colonel Central Section
Board (CSB) with inclusion of her Officer Performance Report (OPR) for the
period of 6 May 2005 through 5 May 2006.

APPLICANT CONTENDS THAT:
The board was not able to consider her promotion based on her most current
performance at that time. Her OPR closed out 10 days before the board;
however, she later discovered during a records review that the report was
not signed by the reviewer until after the board had met. She believes
that with the Definitely Promote (DP) and this OPR on top, reflecting her
selection to a command position, she would have bee selected for a BTZ
promotion. She has prior BTZ selections to major and lieutenant colonel.
In support of the application, the applicant submits her promotion
recommendation and the CY 2006 Selection Board Schedule.

STATEMENT OF FACTS:
Information extracted from the Military Personnel Data System (MilPDS)
indicates the applicant is currently serving in the grade of lieutenant
colonel. Her Total Active Federal Military Service Date (TAFMSD is 9 Jun
87.

the applicant’s military records, are contained in the letter prepared by
the appropriate office of the Air Force at Exhibit C.

AIR FORCE EVALUATION:
HQ AFPC/DPPPO recommends denial. DPPPO states the applicant was not
selected BPZ by the CY06A P0606A CSB; however, she was selected for
promotion to the grade of colonel In-the-Promotion Zone by the CY07A (9 Apr
07) (P0607A) CSB.
DPPPO notes AFI 36-2406, para 3.8.5.6, Officer and Enlisted Evaluation
Systems, states that OPRs on extended active duty (EAD) officers are due at
HQ AFPC no later than 60 days following closeout of the report. The
applicant's OPR closed out on 5 May 06 and was not required to be on file
until 5 Jul 06 (after the board convened). Furthermore, the report was
signed by the rater on 30 May 06, additional rater on 31 May 06, and
reviewer on 1 Jun 06; therefore, it would not have been a matter of record
by the board convening date of 15 May 06. DPPPO opines since many eligible
officers fall into this predicament, approving SSB consideration with a
report not required to be on file would generate unfairness in the current
promotion process. DPPPO concludes the absence of the report does not
constitute an error since it was not required to be filed in the
applicant's Officer Selection Record (OSR) for the P0606A CSB.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 14 Sep
07 for review and comment within 30 days. As of this date, this office has
received no response (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. The applicant has requested SSB
consideration based on the fact that her most current OPR was not a matter
of record at the time the promotion board convened; however, we agree with
the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for our conclusion that
the applicant has not been the victim of an error or injustice. Based on
the foregoing, we find no basis to grant the relief sought in this
application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
