APPLICANT REQUESTS THAT:
He be given credit for time spent in Vietnam on TDY orders from the
Philippines.

APPLICANT CONTENDS THAT:
During 1969 and 1970, he was TDY to Vietnam with the 463 Field Maintenance
Squadron (FMS), Clark AB, PI, several times, most of them for 30 days at a
time. During these tours of duty, he worked on C-130 aircraft at Cam Ranh,
Bien Hoa, Tuy Hoa, and Bu Duop.
He needs credit for in-country (Vietnam) service to prove to the Veterans
Administration (VA) that he is eligible to be treated for the possibility
of exposure to Agent Orange and Post Traumatic Stress Disorder (PTSD).
In support of the appeal, he has provided a copy of a Board of Veteran’s
Appeals Docket Number 96-42 224, dated 9 May 2002, and an undated personal
statement. His application also indicates he has provided a copy of a
listing of all areas served in Vietnam on TDY orders, although no such
document was contained with this application.

STATEMENT OF FACTS:
Applicant served as an aircraft propeller repairman from 11 October 1968
until his release from active duty on 10 October 1972, to include a total
credit of one year, four months, and eight days of foreign and/or SEA
service. He was assigned to the 463 FMS, Clark AB, PI, effective 19 May
1969, and he was awarded the National Defense Service Medal (NDSM), Air
Force Longevity Service Award (AFLSA), and the Air Force Good Conduct Medal
(AFGCM).

AIR FORCE EVALUATION:
AFPC/DPAPP recommends denial. There are no documents in his Master
Personnel Record that show TDYs of any kind while he was assigned to the
463 FMS, Clark AB, PI. Although a memo from the VA states there is a
document in his record that states he was recommended for the award of the
Vietnam Service Medal and Republic of Vietnam Campaign Medal, no such
document was found in his Master Personnel Record.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A complete copy of the evaluation was forwarded to the applicant on 9
February 2007, for review and comment, within 30 days. However, as of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case; however, we agree
with the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for our conclusion that
the applicant has not been the victim of an error or injustice. Applicant
has not provided any documentation, nor are there any documents in his
Master Personnel Record, that show TDYs of any kind while he was assigned
to the 463 FMS, Clark AB, PI. Therefore, in the absence of evidence to the
contrary, we find no compelling basis to recommend granting the relief
sought in this application.
4. The applicant's case is adequately documented and it has not been shown
that a personal appearance with or without counsel will materially add to
our understanding of the issue(s) involved. Therefore, the request for a
hearing is not favorably considered.

The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
