APPLICANT REQUESTS THAT:

He be  awarded  the  Presidential  Unit  Citation  (PUC),  National  Defense
Service  Medal  (NDSM),  and  the  Small  Arms  Expert  Marksmanship  Ribbon
(SAEMR).

Examiner’s Note:  HQ AFPC/DPPPR indicated the applicant is entitled  to  the
NDSM and a DD Form 215 - Correction to the DD Form 214 has  been  issued  to
the applicant.  Therefore, the only issues before the Board are the PUC  and
the SAEMR.

APPLICANT CONTENDS THAT:

He received the  requested  awards  during  his  time  on  active  duty  and
believes they should be added to his records.

STATEMENT OF FACTS:

The applicant enlisted in the Regular Air Force on  30  June  1962  and  was
discharged on 29 June 1966.  He served four years of total active service.

The applicant’s DD Form 214, Armed Forces of the  United  States  Report  of
Transfer or Discharge, reflects he received the following  decoration:   The
Air Force Good Conduct Medal (AFGCM).

AIR FORCE EVALUATION:

AFPC/DPPPR recommends denial  of  the  PUC  and  SAEMR.   DPPPR  states  the
applicant  is  entitled  to  the  NDSM.   The  Retirements  and  Separations
Division will update the applicant’s record.  The PUC is conferred on  units
of the armed forces of the United States and of cobelligerent  nations,  for
extraordinary heroism in action  against  an  armed  enemy  on  or  after  7
December 1941.  Individuals assigned or permanently attached  to,  and  also
present for duty with a unit in the action for which the PUC is awarded  may
wear the emblem as a permanent part of their uniform.  The SAEMR is  awarded
to all U.S. Air Force service members who, after 1 January 1963, qualify  as
“expert” in small-arms marksmanship with either the M-16 rifle or an  issued
handgun.  DPPPR  was  unable  to  locate  an  AF  Form  522  to  verify  the
applicant’s entitlement.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 1 September 2006, the evaluation  was  forwarded  to  the  applicant  for
review and comment within 30 days  (Exhibit  D).   As  of  this  date,  this
office has received no response.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies provided by existing  law  or
regulations.

2.    The application was not timely filed; however, it is in  the  interest
of justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to  demonstrate  the
existence of an error or injustice.  The applicant’s  contentions  are  duly
noted; however, after reviewing the  evidence  of  record,  along  with  the
applicant’s  submission,   the   Board   agrees   with   the   opinion   and
recommendation of the Air Force and adopts its rationale as  the  basis  for
the conclusion that the applicant has not been the victim  of  an  error  or
injustice.  The Board notes evidence has not been provided and there  is  no
documentation in the applicant’s military personnel record  to  substantiate
that the applicant is entitled to the PUC and the SAEMR.  The Board  is  not
unmindful or unappreciative of his service to this Nation and further  notes
his entitlement  to  the  NDSM  has  been  added  to  his  military  record.
However, in the absence of evidence that shows to the  satisfaction  of  the
Board his entitlement to award of the PUC and  SAEMR,  the  Board  finds  no
basis to recommend granting the relief sought.

THE BOARD DETERMINES THAT:

The applicant be notified the evidence presented  did  not  demonstrate  the
existence of an error or an injustice; the application was denied without  a
personal appearance; and the application will only be reconsidered upon  the
submission of newly discovered relevant evidence not  considered  with  this
application.
