APPLICANT REQUESTS THAT:

His records be corrected to reflect he was  awarded  the  Presidential
Unit Citation (PUC), Vietnam Service Medal (VSM), Air Force  Longevity
Award (AFLSA) and the Small Arms Expert Marksmanship Ribbon (SAEMR).

APPLICANT CONTENDS THAT:

He believes he is entitled to the aforementioned awards based  on  his
military service.

In support of his request, the applicant provided a  copy  of  his  DD
Form 214.

Applicant's complete submission, with an attachment,  is  attached  at
Exhibit A.

STATEMENT OF FACTS:

The applicant enlisted in the Regular Air  Force  (RegAF)  on  30 June
1970, as an airman basic (AB) for a period of four years.

The applicant’s records reflect he was awarded  the  National  Defense
Service Medal (NDSM).

The applicant’s performance  report  for  the  period  15  March  1972
through 14 March 1973 notes  the  applicant  was  deployed  to  Korat,
Thailand.

Air  Force  Form  2095,  Assisgnment/Personnel  Action  reflects   the
applicant had a 12-month overseas tour in Thailand.

The applicant was honorably released from the AF on 5 August  1974  in
the grade of sergeant (SGT).  He served four years, one month and  six
days of active duty service.

On 10 August 20006, a DD Form 215  was  issued  changing  his  foreign
service to 1 year, 2 months and 15 days and adding the PUC, AFOUA with
Valor, VSM and the AFLSA to his DD Form 214.

AIR FORCE EVALUATION:

HQ AFPC/DPPPR recommends the requested relief for award of  the  SAEMR
be denied.  HQ AFPC/DPPPR verified the applicant’s entitlement to  the
PUC, AFOUA w/V, VSM and the  AFLSA  and  his  records  were  corrected
administratively to add the awards.   However,  they  were  unable  to
verify his entitlement to the SAEMR and they were unable to locate  an
Air Force Form 522, USAF Ground  Weapons  Training  Data,  showing  he
qualified as an expert with the M-16 or a  handgun  on  an  Air  Force
firing range.  The applicant did  not  provide  any  documentation  to
substantiate his claim.

A complete copy of the Air Force evaluation is attached at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the  applicant  18
August 2006, for review and response.  As of this  date,  no  response
has been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was not timely filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to demonstrate
the existence of an error or an injustice.   We  took  notice  of  the
applicant's complete submission in judging the  merits  of  the  case;
however, we agree with the opinion and the recommendation of  the  Air
Force and adopt its rationale as the basis for our conclusion that the
applicant has not been the victim of an error  or  an  injustice.   As
stated, the applicant’s records will be corrected administratively  to
reflect award of the AFLSA, PUC, AFOUA w/V  and  his  foreign  service
will read 1 year, 2  months  and  15  days.   There  was  no  official
documentation located in the applicant’s military  records  to  verify
his entitlement to the SAEMR.   The  applicant  did  not  provide  any
documentation to substantiate he qualified as an expert with  a  rifle
or a handgun on an Air  force  firing  range.   Without  any  official
documentation to support the applicant’s request, his  entitlement  to
the SAEMR cannot be verified.  Therefore, in the absence  of  evidence
to the contrary, we find no compelling basis to recommend granting the
relief sought in this  application.   However,  should  the  applicant
provide an AF Form 522 substantiating he qualified as an expert on  an
AF firing range, this Board would be willing to review  the  materials
for possible reconsideration.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
