APPLICANT REQUESTS THAT:
His records be corrected to reflect the award of the Small Arms Expert
Marksmanship Ribbon (SAEMR).

APPLICANT CONTENDS THAT:
The absence of the requested awards in his records was a clerical
omission.
In support of the appeal, applicant submits his personal statement, a
photograph, and DD Forms 214 and 215.

STATEMENT OF FACTS:
Applicant is a former member of the Regular Air Force who served on
active duty from 4 Oct 65 to 3 Feb 69. During the period 11 Feb 67 to
10 Feb 68, he was assigned to the 377th Security Police Squadron, Ton
Son Nhut AB, Republic of Vietnam.
The SAEMR is awarded to all United States Air Force service members
who, after 1 Jan 63, qualify as “expert” in small-arms marksmanship
with either the M-16 rifle or issue handgun.

AIR FORCE EVALUATION:
AFPC/DPPPR recommends the application be denied and states, in part,
that they were unable to locate any official documentation, i.e., AF
Form 522, USAF Ground Weapons Training Data or order, verifying that
he qualified expert in small arms. However, they did determine his
eligibility for the Presidential Unit Citation (PUC), the Air Force
Outstanding Unit Award with Valor (AFOUA w/V), an additional service
star to the Vietnam Service Medal (VSM), the Air Force Good Conduct
Medal (AFGCM), the National Defense Service Medal (NDSM), and the
Republic of Vietnam Campaign Medal (RVNCM). His records will be
administratively corrected to reflect these awards. In addition, he
will be provided a replacement set of medals.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 19 May 2006, a copy of the Air Force evaluation was forwarded to
the applicant for review and response. As of this date, no response
has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice to warrant awarding the SAEMR.
The office of primary responsibility has determined the applicant’s
entitlement to the PUC and AFOUA w/V, and administratively corrected
his records accordingly. In view of this, the only issue before this
Board is his request for the SAEMR. In this regard, we note the SAEMR
is awarded to service members who, after 1 Jan 63, qualify as expert
with either the M-16 rifle or issue handgun. We have thoroughly
reviewed the applicant’s military records and the documentation
submitted with his application, and do not find an AF Form 522, USAF
Ground Weapons Training Data or order to verify that he qualified
expert in either of these small arms. Therefore, we find no basis to
recommend granting his request for the SAEMR. However, should he
provide a copy of an AF Form 522 or order indicating that he qualified
as expert in either the M-16 rifle or issue handgun, the Board will
reconsider his request.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
