APPLICANT REQUESTS THAT:
He be awarded the Air Force Commendation Medal with one Oak Leaf
Cluster (AFCM w/1 OLC), and the Small Arms Expert Marksmanship
Ribbon (SAEMR).
Examiner’s Note: On 9 May 05, AFPC indicated they will
administratively correct applicant’s DD Form 214 to reflect the “1
OLC” for the Air Force Commendation Medal and the Korean Defense
Service Medal after the Board action. Therefore, the only issue
remaining to be resolved by the Board is applicant’s request for
the SAEMR.

APPLICANT CONTENDS THAT:
The SAEMR was awarded early in his career; he was unable to find
any backup paperwork. The National Personnel Records Center could
not find anything in his records.
In support of his application he submits a copy of his citation for
award of the AFCM, w/1 OLC.

STATEMENT OF FACTS:
The applicant served on active duty in the Regular Air Force from
2 Aug 62 until his retirement on 1 Dec 79. Prior to enlisting in
the Air Force, the applicant served in the US Navy/Navy Reserve
between 31 Jul 56 and 30 Jul 62. His DD Form 214 reflects he was
awarded the Air Force Commendation Medal, the Air Force Longevity
Service Award, w/4 OLCs, the Air Force Good Conduct Medal, w/4
OLCs, the National Defense Service Medal, the Air Force
Expeditionary Medal, and the Air Force Outstanding Unit Award.

AIR FORCE EVALUATION:
HQ AFPC/DPPPR recommends denial of the applicant’s request for the
SAEMR. They were unable to verify his entitlement to the SAEMR and
were unable to locate an AF Form 522, USAF Ground Weapons Training
Data, or an order showing he had qualified as an expert with the M-
16 or a handgun on an Air Force firing range. They were unable to
locate any official documentation verifying he was awarded the
SAEMR.
The AFCM was authorized by the Secretary of the Air Force on
March 28, 1958, for award to members of the Armed Forces of the
United States who, while serving in any capacity with the Air Force
after March 24, 1958, distinguished themselves by meritorious
achievement and service. After a thorough search of the
applicant’s military record they were able to verify his
entitlement to AFCM w/1 OLC.
They also verified his entitlement to the Korean Defense Service
Medal (KDSM) for the period 25 Oct 67 to 5 Dec 68.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 13 May 05, a copy of the Air Force evaluation was forwarded to
the applicant for review and response within 30 days. As of this
date, no response has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice with respect to the
Small Arms Expert Marksmanship Ribbon (SAEMR). We took notice of
the applicant's complete submission in judging the merits of the
case; however, we agree with the opinion and recommendation of the
Air Force office of primary responsibility and adopt its rationale
as the basis for our conclusion that the applicant has not been the
victim of an error or injustice. Therefore, in the absence of
evidence to the contrary, we find no compelling basis to recommend
granting applicant’s request for award of the SAEMR.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
