APPLICANT REQUESTS THAT:
Her Retirement Year Ending (RYE) 22 December 2003 be changed from an
unsatisfactory year to a satisfactory year or the requirements be waived.

APPLICANT CONTENDS THAT:
She failed to obtain the minimum Retention/Retirement (R/R) requirements
for fiscal year 2003 (FY03). Extenuating circumstances warrant a change in
her record.
She transferred from a traditional Reserve position to the Individual
Mobilization Augmentee (IMA) program in September 2001. She was mobilized
in support of Operation Noble Eagle and assigned to the 959th Surgical
Operations Squadron, 59th Medical Wing at Lackland AFB, Texas, from 1
November 2001 through 31 October 2002. After being demobilized, she began
participating as an IMA based on advice received from the 59th Medical Wing
Reserve Liaison Office and was told that she could start participating
since it was a new FY.
Per AFMAN 36-8002 paragraph 1.4, she is requesting an excusal of meeting
the minimum points for her R/R year due to personal hardship and/or
extraordinary circumstances. She understands that she failed to accomplish
her inactive duty training (IDT) within her R/R dates; however, she was
making an honest effort to meet the requirements for a good year. She
further indicates, during her military career (on active duty and as a
Reservist) she has always worked hard to serve her country. FY03 was no
different for her and despite some very challenging times in her personal
life, she believed that she was fulfilling all the necessary requirements
to maintain her good status in the Reserves.

STATEMENT OF FACTS:
The relevant facts pertaining to this application, extracted from the
applicant's military records, are contained in the letter prepared by the
appropriate office of the Air Force (Exhibit C).

AIR FORCE EVALUATION:
AFPC/DPAPP recommended denial indicating the applicant began participating
on 14 November 2002 and earned 16 IDT points prior to RYE 22 December 2002.
For RYE 22 December 2002, the applicant is credited with 313 active duty
(AD) points, 16 IDT points, 0 Extension Course Institute (ECI) points, 15
membership points, 344 total points and a satisfactory year of Federal
service. Her participation ended June 2003 while she and her family
relocated due to her husband’s reassignment to RAF Lakenheath, England.
For RYE 22 December 2003, the applicant is credited with 12 AD points,
8 IDT points, 0 ECI points, 15 membership points, 35 total points and an
unsatisfactory year of Federal service.
When she began to prepare her application for correction, the applicant
stated that she was advised by her program manager to check her records for
other participation that she could have performed that may not have been
credited for in RYE 22 December 2003. AF Forms 40A document courses she
taught as a certified Trauma Nurse Core Course instructor for which she had
not received point credit. These forms have been approved for point credit
by ARPC Medical IMA Force Management Division and administrative correction
has been accomplished. For RYE 22 December 2003, the member is now
credited with 12 AD points, 20 IDT points, 0 ECI points, 15 membership
points, 47 total points and an unsatisfactory year of Federal service.
Relocation to England caused the applicant to not be able to participate
and earn the required 50 points. A recommendation to disapprove this
application is based on her failure to prove any injustice that prevented
her from earning a satisfactory Federal service year.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
The applicant reviewed the evaluation and responded that she was anxious to
perform as many IDTs as early as possible for 2003 as she was anticipating
moving overseas and wanted to “front load” IDTs for the year in case she
had trouble getting attached to a unit. However, had she been properly
informed of the date she could start to perform IDTs for 2003, she would
not have started until after 23 December 2002. Once she arrived in
England, she felt no pressure to begin IDTs immediately since she was under
the impression that she already accrued enough points for a satisfactory
year. In March 2004, she learned that she had an unsatisfactory year. Had
the 16 IDT points she accrued between 1 October 2002 and 22 December 2002
been added to the 35 points she accrued for RYE 22 December 2003, she would
have had a satisfactory year for 2003. She further indicates that she has
suffered an injustice, namely inaccurate advice from the 59th Medical Wing
Reserve Liaison Office and as a new IMA she depended on their advice and
direction.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice. After a thorough review of the
evidence of record, it is our opinion that corrective action in such a
manner to show the applicant’s RYE ending 22 December 2003 was a
satisfactory year of Federal service is warranted. In this respect, after
review of her submission in light of her history of participation through
her career of military service, we believe that the applicant, acting in
good faith based upon advice she received, made every reasonable effort to
accumulate sufficient points to ensure she completed a satisfactory year of
Federal service. However, through what we believe to be no fault of her
own, she was unable to do so. Accordingly, we recommend she be awarded an
additional three non-paid IDT points for RYE ending 22 December 2003 as
indicated below and her records reflect a satisfactory year of Federal
service.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT, be corrected to show that she was awarded an additional three
(3) non-paid inactive duty training points for retirement/retention year 23
December 2002 through 22 December 2003, resulting in 50 total points; and,
that the period 23 December 2002 through 22 December 2003 is a year of
satisfactory Federal service.

Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to , be corrected to show that she was awarded an additional
three (3) non-paid inactive duty training points for retirement/retention
year 23 December 2002 through 22 December 2003, resulting in 50 total
points; and, that the period 23 December 2002 through 22 December 2003 is a
year of satisfactory Federal service.

The other letter the applicant submitted is from an IMA who claims to have also received misguided information when she entered the IMA program. If the Board rules in favor of the applicant, the Board would have to award the applicant 4 non-paid inactive duty training (IDT) points for Retention Year Ending (RYE) 22 April 1996 and 8 non-paid IDT points for RYE 22 April 1997. Insufficient relevant evidence has been presented to demonstrate the existence of an error or an injustice.
