APPLICANT REQUESTS THAT:
Award of the Air Force Outstanding Unit Award with Valor (AFOUA w/V), Small
Arms Expert Marksmanship Ribbon (SAEMR), and the Republic of Vietnam
Gallantry Cross with Palm (RVNGC w/P) be added to his DD Form 214 (Report
of Separation from Active Duty).
Examiner’s Note: AFPC/DPPPR indicated the applicant’s records show he is
entitled to the AFOUA w/V and the RVNGC w/P and a DD Form 215 - Correction
to the DD Form 214 has been issued to the applicant. Therefore, the only
issue before the Board is the SAEMR.

APPLICANT CONTENDS THAT:
He was awarded the requested awards; however, they were never added to his
DD Form 214.

STATEMENT OF FACTS:
On 20 April 1971, the applicant entered active duty in the Regular Air
Force in the grade of airman basic for a period of four years.
On 28 October 1972, the applicant was honorably discharged in the grade of
airman basic under the provisions of AFM 39-12. He served one year, six
months, and nine days of total active duty service with nine months and
two days of foreign service.
The applicant’s DD Form 214 indicates he received the following decorations
and medals: the National Defense Service Medal, the Republic of Vietnam
Campaign Medal, and the Vietnam Service Medal with One Bronze Service Star.

AIR FORCE EVALUATION:
AFPC/DPPPR recommended denial of the SAEMR indicating they were unable to
verify his entitlement to the SAEMR. They were unable to locate an AF Form
522, USAF Ground Weapons Training Data, showing he had qualified as an
expert with the M-16 or a handgun on an Air Force firing range. He did not
provide any documentation to substantiate his claim.
The applicant was assigned to the 377th Security Police Squadron, Tan Son
Nhut Air Base, Republic of Vietnam, from 28 March 1972 to 26 November 1972;
during which his unit was awarded the AFOUA w/V and the RVNGC w/P.
Therefore, he is entitled to the awards and his DD Form 214 will be
updated.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 24 March 2006, a copy of the Air Force evaluation was forwarded to the
applicant for review and response within 30 days. As of this date, no
response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest
of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice. The applicant’s contentions are duly
noted; however, after thoroughly reviewing the applicant’s submission and
the evidence of record there is no indication in the applicant’s military
personnel record that he is entitled to award of the SAEMR. In order to
verify his eligibility for this award, AF Form 522, USAF Ground Weapons
Training Data, showing he had qualified as an expert with the M-16 or a
handgun on an Air Force firing range is needed and he did not provide any
documentation to substantiate his claim. The Board notes that AFPC/DPPPR
indicated that the applicant is entitled to the AFOUA w/V and the RVNGC w/P
and a DD Form 215 had been issued to the applicant. Therefore, in the
absence of evidence to the contrary, we find no compelling basis to
recommend granting the remaining relief sought.

The applicant be notified the evidence presented did not demonstrate the
existence of an error or an injustice; the application was denied without a
personal appearance; and the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered with this
