APPLICANT REQUESTS THAT:
Her retirement year ending (RYE) 27 July 2001, be changed from an
unsatisfactory year to a satisfactory year.

APPLICANT CONTENDS THAT:
When she left active duty in 1998, and entered the Air Force
Individualized Mobilization Augmentee Reserves, she was simply told by
her recruiter to fulfill a 12-14 day active duty tour and 12-14
inactive duty training days each year and to not do the active duty
tour between August and October.
She worked almost fulltime her first year in the reserves (1998-1999).
She did her annual tour in July as instructed and had a good year.
The 1999-2000 year she did not fulfill her commitment. In August
1999, she was hired by the Federal Aviation Administration (FAA) as an
Air Traffic Controller. She went through intense training. As a
result of this, she did not serve at all in 1999-2000.
In the year 2000-2001, she was still under the impression she was to
serve as instructed by her recruiter. After her bad year and after
she had completed training, she returned to Patrick to resume her
military career and fulfill her commitments. She reported for active
duty on 4 July 2001, served her annual tour, stayed to fulfill the
year’s IDT’s, and returned to Indiana on 3 August under the impression
she had received the proper points for the 2000-2001 year. She was
active duty 4 July 2001 to 16 July 2001 (13 days/13 points) and on
IDT’s 17, 18, 19, 20, 23, 24, 25, 26, 27, 30, 31 July, 1-2 August (13
days/26 points). When she left she thought she got 39 points for the
duty and 15 participation points for the reserves totaling 54 points.

STATEMENT OF FACTS:
The relevant facts pertaining to this application, extracted from the
applicant's military records, are contained in the letter prepared by
the appropriate office of the Air Force.

AIR FORCE EVALUATION:
ARPC/DPP states that according to paragraph 2.2 of Air Force Manual 36-
8001, Reserve Personnel Participation and Training Procedures, points
may only be credited to the date a member actually performed the duty.
Since the applicant performed the IDTs on 30 and 31 July, and 1 and 2
August of 2001, they must be credited to her RYE 27 July 2002. It
would be in violation of Air Force Manual 36-8001 to credit points to
any date other than the date actually performed. Therefore, they
recommend denial of applicant’s request. However, to correct the
applicant’s RYE 27 July 2001, the board would have to award 4 non-
paid IDT points. The applicant’s record would then show 13 AD points,
22 IDT points, 0 ECI points, 15 membership points, 50 total and
retirement points and a year of satisfactory federal service.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Applicant reviewed the Air Force evaluation and states that she would
like to further defend her position and plea for a change of miliary
records. She states that she understands it would be a violation of
Air Force Manual 36-8001 to credit points to any date other than the
date actually performed. However, she thought this would be the most
just action as opposed to just giving her four non-paid points. She
does implore that one or the other be done due to the clearly unclear
explanation of the reserve system she received. She truly had no
intention of not meeting her reserve commitment for FYE 2001, which is
explained in detail in her request.
She asks that her request be considered for four non-paid points or re-
applying four of the RYE 2002 points to her RYE 2001 year. She takes
pride in her Air Force career and served, what she thought, was her
commitment for the RYE 2001 year.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After reviewing the evidence of
record, we are not persuaded that the applicant’s records are in error
or that she has been the victim of an injustice. Her contentions are
noted; however, in our opinion, the detailed comments provided by the
appropriate Air Force office adequately address those allegations.
Therefore, we agree with opinion and recommendation of the Air Force
and adopt their rationale as the basis for the conclusion that the
applicant has not been the victim of an error or injustice. In the
absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly

AIR FORCE EVALUATION: The Director of Personnel Program Management, HQ ARPC/DPP, reviewed this application and stated the record showed that the applicant completed two annual tours of active duty from 17 – 27 September 1992 and 16 – 27 August 1993. They indicated the record also showed for RYE 15 September 1992, the applicant did not complete an annual tour. Based on the audit, the applicant's R/R was changed from 2 October to 14 June. The applicant was notified on 17 April 1999 about the change in his R/R date and that his points were being realigned to coincide with the 14 June R/R date. DPP further states the applicant was notified of the change in his R/R year date in April 1999 and he received an AF Form 526 for RYE 13 June 1999, and furthermore, the applicant had adequate time to earn points for the RYE 13 June 2000.

In their assessment of her claim, the Air Force office of primary responsibility confirms the applicant’s claim concerning the base closing and has recommended her request for credit for a satisfactory year of Federal service for the RYE 4 January 1994 be approved. The other letter the applicant submitted is from an IMA who claims to have also received misguided information when she entered the IMA program. If the Board rules in favor of the applicant, the Board would have to award the applicant 4 non-paid inactive duty training (IDT) points for Retention Year Ending (RYE) 22 April 1996 and 8 non-paid IDT points for RYE 22 April 1997. Insufficient relevant evidence has been presented to demonstrate the existence of an error or an injustice.
