APPLICANT REQUESTS THAT:

1.  His AF Form 475, Education/Training Report (TR) closing  14 Nov  03,  be
included in his Officer Selection Record (OSR)  prepared  for  the  Calendar
Year 2003B (CY03B) Central Major Selection Board.

2.  Corrections  be  made  to  the  Duty  History  section  of  his  Officer
Selection Brief (OSB).

3.  He receive consideration by a Special Selection Board for  promotion  to
the grade of major by the CY03B Central Major Selection Board.

APPLICANT CONTENDS THAT:

Exclusion of the TR did not allow board members to see his performance in  a
significant formal training program.  He requested  a  copy  of  the  report
upon completion of the training program but was told the  report  would  not
be completed until everyone in the class was complete and that TRs  are  not
usually provided to students, but instead they are  provided  a  certificate
of completion.  He was assured the TR would be processed into  his  records.
He requested a copy of his records and found that the  TR  was  not  in  his
OSR.  The TR was completed on 1 Apr 04 and placed into his record on 14  Apr
04.  Given the timeline from when the  report  was  actually  completed  and
when it was placed in his record, it appears if it  had  been  completed  on
time it would have made it into his records prior to the  convening  of  the
board.

He presented his course completion certificate to  the  unit  and  requested
his duty title and AFSC change immediately upon his return from the  course.
 He was told the changes had been completed.  When he reviewed  his  records
in March, he discovered the changes were not reflected on his OSB.

In support of his  request,  applicant  provided  a  personal  statement,  a
statement of support, a  copy  of  his  TR,  and  a  personnel  data  system
printout.  His complete submission with attachments is at Exhibit A

STATEMENT OF FACTS:

Applicant was appointed a second lieutenant on 1 Jul 95 and was  voluntarily
ordered  to  extended  active  duty  on  that  same  date.   He   has   been
progressively promoted to the grade of captain, having  assumed  that  grade
effective and with a date of rank of 16 Jun 99.  He was considered  and  not
selected for promotion to the grade of major by the CY03B and CY04A  Central
Major Selection Boards.

AIR FORCE EVALUATION:

AFPC/DPPPO  recommends  denial.   DPPPO  states  AFI  36-2406,  Officer  and
Enlisted Evaluation Systems, paragraph  6.5.1.3,  states  that  TRs  of  EAD
officers are due at HQ AFPC no later than 60 days following closeout of  the
report.  The 14 Nov 03, report was not required to be on file until  14  Jan
04.  Furthermore, the report was not signed until  1  Apr  04  -  after  the
board convening date of 8 Dec 03.  As such, the report  did  not  exist  for
the CY03B board.

His duty history has  been  verified  by  AFPC/DPAOM6  and  updated  in  the
Assignment History of his  OSB.   A  review  of  the  corresponding  Officer
Performance Reports clearly reflect the duty title data verified by  DPAOM6.
 Therefore, selection board members had this information available  to  them
to base a decision  when  considering  him  for  promotion.   As  such,  the
corrected duty history does not  introduce  any  new  information  that  was
already considered by the board members.

AFPC/DPAOM6 defers a recommendation to DPPPO and states  the  applicant  has
submitted evidence to support his claim of a duty  title  change.   His  OPR
substantiates his duty history should be changed and that his  current  duty
history is accurate.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Copies of the Air Force evaluations were forwarded to  the  applicant  on  3
Feb 06 for review and comment within 30 days.  As of this date, this  office
has received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence  has  been  presented  to  demonstrate  the
existence of  error  or  injustice.   In  this  regard,  we  note  that  the
applicant's current duty history was clearly in error on  his  OSB  prepared
for the CY03B  Central  Major  Selection  Board.   Notwithstanding  the  Air
Force's argument that his correct duty title was reflected  on  his  OPR  we
believe that the determination as to whether or not the  error  on  his  OSB
had a negative impact on his selection status should be  made  by  selection
board members.  In addition, the applicant requests his TR dated 1  Apr  04,
be included in his selection folder.  The TR in question closed  on  14  Nov
03, the CY03B board convened on 8 Dec 03; and,  although  due  to  AFPC  not
later than 60 days after  closeout,  was  not  completed  until  1  Apr  04.
Evidence provided by  the  applicant  indicates  that  TRs  completed  after
successful completion  of  this  particular  training  course  are  normally
processed within five days following the graduation date.  However,  due  to
exigencies beyond his control, it was not completed until six months  later.
 As such we believe that as a result of the untimely processing  of  his  TR
and errors contained on his selection brief his records, the  applicant  has
suffered  an  injustice  and  we  further  believe  his  records  should  be
corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to APPLICANT be corrected to show that:

a.  The Officer Selection Brief (OSB) prepared for the Calendar  Year  2003B
Central Major Selection Board be amended in the Assignment  History  Section
to reflect the following:  the 30 May 2001 entry be corrected to  reflect  a
Duty Title of "Pilot, C-130E"  rather  than  "Asst  Flt  CC/Pilot,  C-130E";
effective 19 January 2002, DAFSC "11A2K," Duty Title "Asst Flt CC/Pilot,  C-
130E," LVL "AM," MAJ "AMC," Organization "Airlift  Sq  Pope";  effective  19
January 2003, DAFSC "11A3K," Duty Title  "Asst  Ch  Pilot/AC,  C-130E,"  LVL
"W/B," MAJ "AMC," Organization Airlift  Sq  Pope,";  effective  15  November
2003, DAFSC "11A3K," Duty Title "Asst Ch Pilot/AC  CC,  C-130E,"  LVL  "AM,"
MAJ "AMC," Organization "Airlift Sq Pope."

b.  Section IV of the Training Report (TR), AF Form 475,  rendered  for  the
period of 7 August 2003 through 14 November 2003 was amended to reflect  the
date 6 December 2003 vice 1 April 2004; and was accepted  for  file  in  his
Officer Selection Record on 7 December 2003.

It  is  further  recommended  that  his  record,  to   include   the   above
corrections, be considered by a Special Selection  Board  for  promotion  to
the grade of major by the  CY03B  Central  Major  Selection  Board  and  any
subsequent boards in which the  above  corrections  were  not  a  matter  of
record.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:

      The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that:

            a.  The Officer Selection Brief (OSB) prepared for the Calendar
Year 2003B Central Major Selection Board be amended in the Assignment
History Section to reflect the following:  the 30 May 2001 entry be
corrected to reflect a Duty Title of "Pilot, C-130E" rather than "Asst Flt
CC/Pilot, C-130E"; effective 19 January 2002, DAFSC "11A2K," Duty Title
"Asst Flt CC/Pilot, C-130E," LVL "AM," MAJ "AMC," Organization "Airlift Sq
Pope"; effective 19 January 2003, DAFSC "11A3K," Duty Title "Asst Ch
