APPLICANT REQUESTS THAT:

Her Army Achievement and Army Commendation Medals earned during her  service
in the Army (1993-1997) be filed in her Air Force Officer  Selection  Record
(OSR), her duty title, Clinical Nurse, Medical/Oncology, be added under  the
Assignment History  on  her  Officer  Selection  Brief  (OSB)  prepared  for
consideration by the CY03B Major Selection Board, and her  corrected  record
be considered by a Special Selection Board (SSB) for promotion by the  CY03B
Major Selection Board.

APPLICANT CONTENDS THAT:

She was wrongfully advised by the Travis AFB military personnel flight  that
her Army medals and accomplishments could not be included in her  Air  Force
Personnel record.  The Officer Performance Report (OPR) for  the  period  of
13 February 1997 through 12 February 1998 was in her  record  but  the  duty
title was not annotated  on  the  Officer  Selection  Brief.   This  omitted
information would have made her record more competitive at the  CY03B  Major
board.

In support of the application,  the  applicant  submits  her  personal  data
information, copies of her Army Achievement  Medal,  her  Army  Commendation
Medal,  and  her  OPR  for  the  period  ending  12 February  1998,  and   a
Recommendation for Award (DA Form 638).

STATEMENT OF FACTS:

Information extracted from  the  Military  Personnel  Data  System  (MilPDS)
indicates that, on 1 January 1997, the applicant was  appointed  a  captain,
Reserve of the Air Force, and was voluntarily  ordered  to  extended  active
duty in that grade on 13 February 1997.  Based on her prior service she  has
a Total Federal Commissioned Service Date of  16  April  1993  and  a  Total
Active Federal Commissioned Service Date of 18 September 1993.
The following  is  a  resume  of  her  Officer  Performance  Report  ratings
commencing with the report closing 12 February 1998.

AIR FORCE EVALUATION:

HQ AFPC/DPAMF2 recommends approval of  the  correction  to  the  applicant’s
duty title history.   DPAMF2 states the  applicant  had  an  AF  Form  707B,
Company Grade Officer Performance Report  on  file  with  a  duty  title  of
“Clinical Nurse, Medical Oncology Unit” and a period of report from  13  Feb
97 thru 12 Feb 98.  DPMAF2 notes the duty history  and  duties  on  the  OPR
have been verified and reflect pertinent data to support correction  to  the
applicant’s duty history on the OSB to  “Clinical  Nurse,  Medical  Oncology
Unit.”

HQ  AFPC/DPPPO  recommends  denial.   DPPPO  states  each  eligible  officer
receives an Officer Preselection  Brief  (OPB)  90-100  days  prior  to  the
central board convening date, which contains data appearing on  the  OSB  at
the central board.  The officer  is  instructed  to  carefully  examine  the
brief for completeness and accuracy, and if any errors are  found,  to  take
corrective action in a timely manner.  DPPPO notes the  applicant  does  not
provide an explanation or documentation to show  what  action  she  took  to
correct her OSB and ensure her  record  was  complete  prior  to  the  board
convening date.  DPPPO states although  the  applicant’s  duty  position  as
“Clinical Nurse, Medical Oncology Unit” was  missing  on  her  OSB,  it  was
reflected on her corresponding  OPR  closing  12 Feb  98,  which  the  board
members saw and took into consideration in  evaluating  her  record.   Thus,
the corrected duty history does not introduce any new information  that  was
not already considered by  the  board  members.   DPPPO’s  evaluation,  with
attachments, is at Exhibit D.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

In her response to the Air Force evaluation, the  applicant  reiterated  her
initial comments (Exhibit F).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence  has  been  presented  to  demonstrate  the
existence of probable error or injustice.  After reviewing  the  applicant’s
submission and the evidence of record, we are persuaded that  the  applicant
may not have been fairly considered for promotion by the CY03B  (8  Dec  03)
(P0403B) Major Central Selection Board  (CSB).   Through  no  fault  of  the
applicant, her record was incomplete at the time she was considered  by  the
selection board in question in that the citations for the  Army  Achievement
and Army Commendation Medals earned during her service in  the  Army  (1993-
1997), were not on file in her Officer Selection  Record  (OSR)  before  the
subject selection board.  As a consequence, her decorations  were  also  not
reflected  on  the  Officer  Selecton  Brief  (OSB).   While  it  cannot  be
conclusively  determined  what  impact  the  omission  of  the   information
pertaining to her Army awards and her incorrect duty duty history  may  have
had on the applicant’s promotion opportunity, we believe any doubt  in  this
case should be resolved in  her  favor.   In  view  of  the  foregoing,  the
applicant’s records be corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to  APPLICANT,  be  corrected  by  amending  the  Officer  Selection  Brief,
prepared for the Calendar  Year  2003B  Major  Central  Selection  Board  as
follows:

      a.  Under the Assignment History  Section,  the  duty  title  Clinical
Nurse, Medical/Oncology, effective date 13 February 1997, be added.

      b.  The effective date of her  assignment  to  duties  as  a  Diabetes
Nurse Educator, Medicine Clinic, be changed to 13 February 1998.

      c.  Under the decorations section,  add  the  Army  Achievement  Medal
awarded for the period  25  May  1995  to  5 September  1995  and  the  Army
Commendation Medal awarded for the period 22 November 1993  to  30  December
1996.

It is  further  recommended  that  her  corrected  record,  to  include  the
Citations Accompanying the award of the Army Achievement Medal and the  Army
Commendation Medal, be considered for promotion to the grade of major  by  a
Special Selection Board for the Calendar Year 2003B Major Central  Selection
Board.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of
Section 1552, Title 10, United States Code (70A Stat 116), it is directed
that:

      The pertinent military records of the  Department  of  the  Air  Force
relating APPLICANT, be corrected by amending the  Officer  Selection  Brief,
prepared for the Calendar  Year  2003B  Major  Central  Selection  Board  as
follows:

          a.  Under the Assignment History Section, the duty title Clinical
Nurse, Medical/ Oncology, effective date 13 February 1997, be added.

          b.  The effective date of her assignment to duties as a Diabetes
Nurse Educator, Medicine Clinic, be changed to 13 February 1998.

          c.  Under the decorations section, add the Army Achievement Medal
awarded for the period 25 May 1995 to 5 September 1995 and the Army

            It is further directed that her corrected record, to include
