APPLICANT REQUESTS THAT:
He be given Special Selection Board (SSB) consideration by the
Calendar Year 2004B (CY04B) Lieutenant Colonel Central Selection Board
(CSB), with a corrected Officer Selection Brief (OSB).

APPLICANT CONTENDS THAT:
His OSB was missing data pertaining to the schools he attended and his
assignment history. He believes the missing data reflected poorly and
may have influenced the CY04B board. The missing data was overlooked
due to his attempts to correct other areas of his record since his
return to active duty.
In support of his appeal, the applicant provided copies of his OSB and
officer selection record (OSR).

STATEMENT OF FACTS:
Information extracted from the Personnel Data System (PDS) indicates
that the applicant is currently serving on active duty in the grade of
major, with a date of rank (DOR) of 2 Jun 00. His Total Active
Federal Military Service Date (TAFMSD) is 8 May 93.

AIR FORCE EVALUATION:
AFPC/DPAO indicated the applicant’s OSB contained incorrect assignment
history and academic education information, and his OSB should be
updated. Regarding the applicant’s request for an SSB, they deferred
to AFPC/DPPPO.
A complete copy of the AFPC/DPAO evaluation is at Exhibit C.
AFPC/DPPPO recommended denial of the applicant’s request for an SSB
with a corrected OSB. However, if relief is granted, they offered
their recommendation as to the corrective action they believe would be
appropriate.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Applicant reviewed the advisory opinion and furnished a response
reiterating his request for an SSB. He indicated he has attempted to
correct his records multiple times since receiving the Record Review
Checklist for the CY04B board. The confusion and missing data was
around the time he transferred between the active duty and reserves.
He believes that the missing data could have negatively influenced the
board.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice warranting corrective action
concerning the applicant’s request he be provided SSB consideration
with a corrected OSB. The applicant's complete submission was
thoroughly reviewed and his contentions were duly noted. However, we
do not find the applicant’s assertions and the documentation presented
in support of his appeal sufficiently persuasive to override the
rationale provided by AFPC/DPPPO regarding his request for SSB
consideration. It appears the applicant's assignment history and
academic education information has been updated to reflect the correct
information. However, notwithstanding the applicant’s assertions to
the contrary, no evidence has been presented which has shown to our
satisfaction he exercised the necessary diligence to ensure the
accuracy of his record prior to being considered for promotion by the
CY04B board. In view of the foregoing, and in the absence of
sufficient evidence to the contrary, we adopt AFPC/DPPPO's rationale
concerning SSB consideration and conclude that no basis exists to
recommend granting the requested relief.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
