IN THE MATTER OF: DOCKET NUMBER: BC-2003-01591
INDEX CODE: 131.00
COUNSEL: NONE
HEARING DESIRED: NO
_________________________________________________________________
APPLICANT REQUESTS THAT:
1. Her Officer Selection Record (OSR) prepared for the Calendar Year
2002B (CY02B) Lieutenant Colonel Selection Board be corrected to include
her Nurse Anesthesia recertification.
2. Her Officer Selection Brief (OSB) for the CY02B Lieutenant Colonel
Selection Board be corrected to reflect her correct Duty Air Force
Specialty Code (DAFSC) and that she receive Special Selection Board (SSB)
consideration for promotion to the grade of lieutenant colonel for the
CY02B Selection Board.
_________________________________________________________________
APPLICANT CONTENDS THAT:
Pertinent documentation was not included in her OSR for the CY02B
lieutenant colonel selection board. Her Nurse Anesthesia recertification
was not in her records and her DAFSC incorrectly included an “M” prefix.
In support of her appeal, the applicant provided her Officer Pre-Selection
Brief, dated 23 July 2002 and 5 September 2002 and other documentation.
Applicant’s complete submission, with attachments, is at Exhibit A.
_________________________________________________________________
STATEMENT OF FACTS:
The applicant is currently serving on extended active duty in the grade of
major effective and with a date of rank (DOR) of 1 May 1996.
Applicant was considered and not selected for promotion to the grade of
lieutenant colonel by the CY00A (28 November 2000), CY01B (5 November
2001), and the CY02B (12 November 2002) Central Lieutenant Colonel
Selection Boards.
The applicant’s OSB for the CY02B board reflected an “M” prefix on her
DAFSC under “Assignment History.”
The applicant’s OSR before the CY02B lieutenant colonel board did not
contain the paper copy of her Nurse Anesthesia recertification. However,
the OSB for the CY02B did reflect a “YES” entry in the board certified
block.
OPR profile since 1995 follows:

AIR FORCE EVALUATION:
AFPC/DPAMF2 had no recommendation. They indicated that the applicant was
certified in Nurse Anesthesia when the CY02B lieutenant colonel board met.
Applicant’s “M” prefix was present on her DAFSC incorrectly and should have
been attached to her Primary AFSC. Per AFI 36-2105, dated 31 October 2002,
“Do not affix the “M” prefix to the “Duty” AFSC of officers;” however, the
prefix is attached to the “Primary” AFSC to show board certification.”
The evaluation is at Exhibit C.
AFPC/DPPPO recommended denial. They indicated that based on the evidence
provided, and the advisory from AFPC/DPAMF2, they recommend denial for SSB
consideration.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 8 August 2003, copies of the Air Force evaluations were forwarded to the
applicant for review and response within 30 days. As of this date, no
response has been received by this office.
_________________________________________________________________
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice to warrant providing the applicant
consideration by a Special Selection Board for the Calendar Year CY02B
Central Lieutenant Colonel Selection Board. Based on the evidence of
record, the applicant has established that numerous errors in her records
were reviewed by the selection board in question. While it cannot be
conclusively determined whether or not these errors were the reason for her
nonselection, the Board believes that it served to deprive her of fair and
equitable consideration. Therefore, the Board recommends her record be
corrected to the extent indicated below.
_________________________________________________________________
THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT, be corrected to show that:
a. The Field Grade Officer Performance Report (OPR), AF Form 707A,
rendered for the period 7 May 2002 through 13 December 2002, be amended in
Section 1, Item 4, Duty Air Force Specialty Code (DAFSC) to read 46M3, vice
M46M3.
b. The Officer Selection Brief (OSB) prepared for the Calendar Year 2002B
Central Lieutenant Colonel Selection Board be corrected in the Assignment
History Section by removing the “M” prefix from the DAFSCs effective 20
January 1998, 29 December 1998, 22 January 2000, and 6 May 2002, thereby
changing the DAFSCs on each of those dates to read 46M3.
c. The Officer Selection Record (OSR) prepared for the Calendar Year 2002B
Central Lieutenant Colonel Selection Board include her Nurse Anesthesia
recertification, with an expiration date of 31 July 2004.
It is further recommended that the corrected record be considered for
promotion to the grade of lieutenant colonel by a Special Selection Board
for the Calendar Year 2002B Central Lieutenant Colonel Selection Board.

Applicant’s OSB for the CY02B board dated 4 November 2002 incorrectly shows the “M” prefix on her “Duty” AFSC under “Assignment History.” Further, applicant submitted copies of her Officer Preselection Brief (OPB) dated 23 July 2003 for the CY02B board which indicates a duty title on 4 February 2001 as “Ambulatory Procedures/Nurse Anesthetist Chief” which was not shown on her OSB when meeting the CY02B board. Based on AFPC/DPAMF2’s advisory and the evidence provided, they recommend SSB...

______________________________________________________________ AIR FORCE EVALUATION: AFPC/DPAMM states that a review of the applicant’s duty title shows her duty titles dated 3 June 1999 to 3 September 2002 are reflected exactly as they are on OPRs provided for reference. They also agree that the applicant’s Master’s Degree in Anesthesia should have been reflected on her OSB, and that she be considered for promotion to the grade of colonel by Special Selection Board for the CY02B selection...

Her record did not contain a copy of her updated Nursing Certification. Applicant contends that her records were not fairly assessed because her Officer Selection Record (OSR) did not contain a copy of the renewed inpatient obstetric nursing certificate. The Air Force has indicated that although a copy of the renewed nursing certificate was not in her OSR, the Officer Selection Brief (OSB) assessed by the Board, did show that she was board certified; therefore, the board members were aware...

The applicant failed to exercise reasonable diligence in maintaining his record prior to the CSBs; therefore, that office recommends denial of the applicant’s request for SSB consideration with the corrected DAFSC. Applicant’s Officer Selection Brief (OSB) and Officer Performance Report (OPR) for the period 22 May 1992 to 10 May 1993, did not reflect his correct Duty Air Force Specialty Code S1555E at the time he was considered for promotion by the CY00A, CY01B, CY02B and the CY03A...

Her overseas duty history was not on her OSB when the CY02B lieutenant colonel board met; however, her current duty has since been updated and does reflect completion of the overseas assignment to Turkey. The DPAMF2 evaluation is at Exhibit C. AFPC/DPPPO recommends denial. DPPPO states that completion of training courses are not reflected on OSBs; however, a training report filed in her Officer Selection Record (OSR) documented her attendance and completion of the course in 1991.

_________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPAO states that the applicant’s CY02 Lieutenant Colonel Selection Board Officer Selection Brief (OSB) had inaccurate duty history information, which has now been corrected. A complete copy of their evaluation, with attachment, is at Exhibit C. AFPC/DPPPO states that they disagree with the applicant’s contention that his MSM, 1OLC, decoration was missing from his Officer Selection Record (OSR) when...

3. Corrections be made to the Overseas Duty History, Academic Education, and Assignment History of the CY02B OSB. DPAO deleted two entries from his duty history "because TDY duty history is not updated in a member's duty history." The applicant requests numerous corrections be made to his OSR as it met the CY02B Lieutenant Colonel Selection Board and that he receive SSB consideration for promotion by that board.

In regards to the applicant’s request to change the DAFSC on his PRF viewed by the CY02B Lieutenant Colonel Central Selection Board, they note that while it was appropriate for the ERAB to correct the applicant’s DAFSC on his OPR, it is not appropriate to make changes to the PRF.
