APPLICANT REQUESTS THAT:
She be reimbursed in the amount of $126.00 for premiums paid on her Family
Servicemember’s Group Life Insurance (FSGLI).

APPLICANT CONTENDS THAT:
The FSGLI announcements occurred while she was deployed. Her active duty
spouse was also deployed in support of SOUTHERN WATCH. The deployed
personnel team did not advertise information regarding FSGLI. She did not
notice the notification of FSGLI on her LES until she tried to change
erroneous dependent information at the base level customer service counter
in December 2002. Based on the inability to receive information regarding
FSGLI, she requests full refund of the premiums paid on her FSGLI.
In support of her appeal, the applicant submits copies of her LES for the
period 1 August 2001 through 30 November 200 and for the period 1-31
January 2003. Applicant’s submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:
The applicant is currently serving on active duty in the grade of major,
effective and with a date of rank of 1 May 1999.
Public Law 107-14, Veterans’ Survivor Benefits Improvement Act of 2001 was
passed on 5 June 2001 and approved by the President. The law expanded the
Servicemen’s Group Life Insurance (SGLI) program to establish coverage for
spouses and children in the event of their death. The coverage, by law,
was automatic for all members of the Armed Forces who had a spouse or
child(ren), unless the member declined coverage.

AIR FORCE EVALUATION:
HQ AFPC/DPW recommends the application be denied. DPW states that, on 20
May 2003, the applicant was notified that they were unable to process her
request without additional documentation. DPW requested the applicant
provide a copy of her SGLV 8286A, Family Coverage Election Certificate,
declining coverage and any documentation to support her claim. Applicant
did not respond or provide the additional information needed to
sufficiently evaluate her claim. The HQ AFPC/DPW evaluation, with
attachment, is at Exhibit B.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 5
September 2003 for review and response. As of this date, this office has
received no response (Exhibit C).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We note that the applicant has not
responded to HQ AFPC/DPW’s request for additional information in order to
sufficiently evaluate her claim. Absent such evidence, it is our opinion
that no basis exists to reimburse the premiums withheld. Therefore, the
applicant’s request is not favorably considered.

The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.

On 13 June 2003, the applicant declined FSGLI coverage on SGLV 8286A, Family Coverage Election. The applicant’s Leave and Earnings Statement dated for the month of May 2003, indicates a total debt of $360 for FSGLI premiums from 1 November 2001 through 30 April 2003. DPW states that in accordance to public law, although premiums had not yet been deducted from her pay, the applicant’s spouse was insured for $100,000 for the period 1 November 2001 through 30 June 2003.
