APPLICANT REQUESTS THAT:
She be reimbursed for premiums deducted from her pay for Family
Servicemen’s Group Life Insurance (FSGLI) since 1 August 2002.

APPLICANT CONTENDS THAT:
She noticed a $13.00 discretionary allotment and a $26.00 debt listed
on her November 2002 Leave and Earning Statement (LES). She went to
finance to determine the source and was told it was for FSGLI coverage
for her spouse. She questioned the response and was referred to the
Military Personnel Flight (MPF) who then gave her the paperwork to
decline coverage for her spouse. In early September 2002, she went to
the MPF and completed all paperwork given to her for marital status
change.
At no time was she given paperwork to decline coverage for her spouse
nor was she briefed that this needed to be done. Because this did not
show up until her November LES, she could not take corrective action
sooner. Aviano MPF told her there was no way to recover this money.
In fact, the customer service representative told her she should feel
lucky because one couple did not notice the allotment for one year and
they would not be able to recover their funds. Then when she arrived
in Michigan in late December 2002, her husband told her to use this
form to try to retrieve the money.

STATEMENT OF FACTS:
The applicant is currently serving on extended active duty in the Air
Force in the grade of captain.
Applicant paid FSGLI premiums from August 2002 to November 2002.

AIR FORCE EVALUATION:
AFPC/DPW recommended denial due to lack of sufficient evidence to
support the claim.
AFPC/DPW complete evaluation is attached at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A complete copy of the Air Force evaluation was forwarded to the
applicant on 18 April 2003, for review and comment. As of this date,
no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of an error or injustice. After a thorough review of
the evidence of record and applicant’s submission, we are not
persuaded the applicant should be reimbursed for the FSGLI premiums
she paid from August 2002 to November 2002. Applicant’s contentions
are duly noted; however, we do not find these assertions, in and by
themselves, sufficiently persuasive to override the rationale provided
by the office of primary responsibility. We therefore agree with
their recommendation and adopt the rationale expressed as the basis
for our decision that the applicant has failed to sustain her burden
of having suffered either an error or an injustice. In view of the
above and absent persuasive evidence to the contrary, we find no
compelling basis to recommend granting the relief sought.

demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

On 13 June 2003, the applicant declined FSGLI coverage on SGLV 8286A, Family Coverage Election. The applicant’s Leave and Earnings Statement dated for the month of May 2003, indicates a total debt of $360 for FSGLI premiums from 1 November 2001 through 30 April 2003. DPW states that in accordance to public law, although premiums had not yet been deducted from her pay, the applicant’s spouse was insured for $100,000 for the period 1 November 2001 through 30 June 2003.
