APPLICANT REQUESTS THAT:
He be reimbursed for premiums paid on his Family Servicemember’s Group Life
Insurance (FSGLI).

APPLICANT CONTENDS THAT:
FSGLI premiums have been deducted from his pay since 1 November 2001.
After being contacted by the Military Personnel Flight NCOIC of Customer
Service in September 2002, he elected to enroll his spouse in FSGLI
effective September 2002. However, when he received his October 2002 LES,
he noticed he had a debt of $143 for FSGLI premiums owed since November
2001. He checked with the finance office and Customer Service NCOIC and
was informed that the FSGLI was effective in November 2001. He was
miscounseled by the Customer Service NCOIC. He would have decline coverage
had he known the payments would have been retroactive to November 2001. He
cancelled his FSGLI and was told he would have to apply to the BCMR for
reimbursement of the premiums already deducted.
In support of his application, the applicant submits copies of his Leave
and Earnings Statements (LES) for the months of October, November, and
December 2002. The applicant’s complete submission, with attachments, is
at Exhibit A.

STATEMENT OF FACTS:
The applicant is currently serving on active duty in the rank of master
sergeant (E-7). His Total Active Federal Military Service Date is 27 July
1982.
On 27 May 2003, AFPC/DPW notified the applicant that they were unable to
process his request without additional documentation. DPW requested the
applicant provide a copy of his SGLV 8286A, Family Coverage Election
Certificate, declining coverage and any documentation to support his claim.

AIR FORCE EVALUATION:
AFPC/DPW recommends the application be denied. DPW states that the
applicant did not provide the additional information needed to sufficiently
evaluate his claim. The DPW evaluation is attached at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force Evaluation was forwarded to the applicant on 15
August 2003, for review and comment within 30 days. As of this date,
this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. The applicant was properly charged with a
debt as a result of the passage of Public Law 106-419, Section 312,
effective 1 April 2001, which automatically increased the level of SGLI
coverage. Since the applicant did not provide the additional information
requested in order to sufficiently evaluate his claim, it is our opinion
that no basis exists to reimburse the premiums withheld. Therefore, the
applicant’s request is not favorably considered.

The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.

On 13 June 2003, the applicant declined FSGLI coverage on SGLV 8286A, Family Coverage Election. The applicant’s Leave and Earnings Statement dated for the month of May 2003, indicates a total debt of $360 for FSGLI premiums from 1 November 2001 through 30 April 2003. DPW states that in accordance to public law, although premiums had not yet been deducted from her pay, the applicant’s spouse was insured for $100,000 for the period 1 November 2001 through 30 June 2003.
