APPLICANT REQUESTS THAT:
His Retention Year Ending (RYE) 15 September 1992, be changed from an
unsatisfactory year to a satisfactory year, by moving his annual tour
points earned during RYE 15 September 1993 to RYE 15 September 1992.
APPLICANT CONTENDS THAT:
His annual tour for RYE 15 September 1992 ran into the next year. Due to
this misalignment, he ended the year one point short of a good year. Had
he realized that his retention year coincided with his enlistment date he
would have scheduled his annual tour sooner.
In support of his appeal, the applicant submitted copies of his annual tour
orders for the years in question, and a copy of AF Form 526, dated 22
November 1999.

STATEMENT OF FACTS:
The relevant facts pertaining to this application, extracted from the
applicant’s military records, are contained in the letter prepared by the
appropriate office of the Air Force. Accordingly, there is no need to
recite these facts in this Record of Proceedings.
AIR FORCE EVALUATION:
The Director of Personnel Program Management, HQ ARPC/DPP, reviewed this
application and stated the record showed that the applicant completed two
annual tours of active duty from 17 – 27 September 1992 and 16 – 27 August
1993. A total of 23 active duty (AD) points were credited for these two
tours. They stated the applicant’s current records show 23 AD points, 34
inactive duty training (IDT) points, 0 Extension Course Institute (ECI)
points, 15 membership points, 72 total and retirement points and a year of
satisfactory federal service (for RYE 15 September 1993).
They indicated the record also showed for RYE 15 September 1992, the
applicant did not complete an annual tour. His record shows 0 AD points,
34 IDT points, 0 ECI points, 15 membership points, 49 total and retirement
points and an unsatisfactory year of federal service.
They recommended the application be disapproved. IAW AFM 36-8001, Reserve
Personnel Participation and Training Procedures, points may only be
credited to the date a member actually performed the duty. It would be a
violation of AFM 36-8001 to credit points to any other date other than the
date actually performed (Exhibit C).
APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 04 August 2000, a copy of the evaluation was forwarded to the applicant
for review and comments (Exhibit D). As of this date, no response has been
received by this office.
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice. We took notice of the
applicant's complete submission in judging the merits of the case; however,
we agree with the opinion and recommendation of the Air Force office of
primary responsibility and adopt their rationale as the basis for our
conclusion. While we were sympathetic to the circumstances surrounding the
applicant’s request, we found no evidence that the Air Force committed an
error or created an injustice to the applicant. Therefore, in the absence
of evidence to the contrary, we find no compelling basis to recommend
granting the relief sought in this application.
THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of probable material error or injustice; that the application
was denied without a personal appearance; and that the application will
only be reconsidered upon the submission of newly discovered relevant
evidence not considered with this application.

The other letter the applicant submitted is from an IMA who claims to have also received misguided information when she entered the IMA program. If the Board rules in favor of the applicant, the Board would have to award the applicant 4 non-paid inactive duty training (IDT) points for Retention Year Ending (RYE) 22 April 1996 and 8 non-paid IDT points for RYE 22 April 1997. As of 23 Jul 03, the applicant has successfully completed 15 years of satisfactory service and during RYE 23 Jul 92, he earned a total of 49 points which gave him his only unsatisfactory year of service in his career.
