APPLICANT REQUESTS THAT:
He be credited with an additional point during Retirement Year
Ending (RYE) 23 July 1992.

APPLICANT CONTENDS THAT:
He was given a bad year for missing one point during RYE
23 July 1992. That year he started a new civilian job which
required him to attend additional training. He states that his
records are correct with no errors but are unjust.
In support of his appeal, applicant submitted a printout of his
Reserve Participation Service History, dated 24 Jan 04.

STATEMENT OF FACTS:
Applicant enlisted in the Air Force Reserve on 24 Jul 87. He is
currently assigned in the Information Management career field. He
was promoted to the grade of technical sergeant with an effective
date and date of rank of 1 May 98.
Applicant’s ANG/USAFR Point Credit Summary reflects that during RYE
23 Jul 92, he was credited with 49 total and retirement points and
an unsatisfactory year for retirement.
He has been credited with 15 years of satisfactory federal service
towards retirement.
In accordance with AFM 36-8001, a reserve member is required to
earn a minimum of 50 points (including membership points) in their
full Retention/Retirement (R/R) year for award of a year of
satisfactory federal service for retirement.

AIR FORCE EVALUATION:
HQ ARPC/DPP reviewed this application and recommended denial. They
found no injustice in this case. Applicant has been awarded all
earned points. As of 23 Jul 03, the applicant has successfully
completed 15 years of satisfactory service and during RYE
23 Jul 92, he earned a total of 49 points which gave him his only
unsatisfactory year of service in his career. He has been a
Reservist since 24 Jul 87 and should be fully aware of the
requirement for a satisfactory R/R year.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant
on 11 Jun 04 for review and comment within 30 days. As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice of
the applicant's complete submission in judging the merits of the
case. Based on the evidence of record and that verified by HQ Air
Reserve Personnel Center (HQ ARPC), the applicant was given credit
for all of his participation performed during the Retirement Year
Ending (RYE) 23 Jul 92. As a member of the Air Force Reserve/Air
National Guard, the applicant was responsible for ensuring that his
participation requirements were met. He has been a member of the
Air Force Reserve since 24 Jul 87 and should be fully aware of the
requirements for a satisfactory Retention/Retirement year.
Therefore, we agree with the opinion and recommendation of the Air
Reserve Personnel Center and adopt their rationale as the basis for
our conclusion that the applicant has not been the victim of an
error or injustice. In the absence of evidence to the contrary, we
find no compelling basis to recommend granting the relief sought in
this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
