HEARING DESIRED: NO

APPLICANT REQUESTS THAT:
He be credited with eight ( 8 ) non-paid Inactive Duty Training
(IDT) points for the period 3 0 September 1 9 9 2 to 2 9 September--*-

STATEMENT OF FACTS:

The relevant facts pertaining to this application, extracted from
the applicant's military records, are contained in the letter

recite these facts in this Record of Proceedings.

AIR FORCE EVALUATION:

The Director of Personnel Program Management, HQ ARPC/DP,
reviewed the application and states that in early October 1992,
the Nonaffiliated Reserve Section
after being tr
(NARS) from the
National Guard, applicant applied
dual Mobilization Augmentee (IMA)
and was approve
program assignment.

Because of
scheduled
for reassignment to another reserve unit which took approximately
four months to process. Because of the four-month delay, the
applicant did not have a satisfactory year for retirement year
ending 2 9 September 1 9 9 3 .
Applicant's request for points for

cannot be credited
These are not
courses given by the ECI; therefore, no ECI points can be given.
HQ ARPC/DP recommends applicant be credited with the appropriate
number of points to reflect a satisfactory year of Federal
service for retirement.

A complete copy of the Air Force evaluation is attached at
Exhibit C.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing --
law or regulations.
2 . The application was timely filed.
3 . Sufficient relevant evidence has been presented to
demonstrate the existence of probable error or injustice
warranting partial relief. We note that after the applicant had
been approved for an IMA position and was assigned to McGuire
AFB, that base was scheduled for closure and he had to be
reassigned to another reserve unit. However, when the process of
reassignment started, there was a four-month delay causing the
applicant's inability to perform in his unit and earn the
required number of retirement points to qualify for a
satisfactory year of Federal service. HQ ARPC/DP states that the
applicant's request for reassignment could have been delayed due
to Desert Shield/Desert Storm. In view of the length of time it
took to process the applicant's reassignment to another reserve
unit and in an effort to remove any possibility of an injustice
to the applicant, we agree with the ARPC/DP recommendation.
Applicant's request for eight additional Inactive Duty Training
(IDT) points is not favorably considered. In view of the fact
that his reserve point credit summary was p7eviously adjusted to
reflect 17 Active Duty Training (ADT) points, as indicated by the
Lead Technician at ARPC, only six IDT points need be credited to
give him a satisfactory year for retirement for the retirement
Theref ore , we recommend his
year ending 2 9 September 1 9 9 3 .
records be corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that he was credited
with an additional 6 non-paid Inactive Duty Training (IDT) points
during the retirement/retention year 30 September 1 9 9 2 through
2 9 September 1 9 9 3 , resulting in 17 active duty training (ADT)

points, 1 8 IDT points, and 15 membership points for a total of 50
retirement points; and, that the period 3 0 September 1 9 9 2 through
2 9 September 1 9 9 3 is a year of satisfactory Federal service for
retirement.

3. The following is an analysis of the circumstances surrounding this case:

Subsequent to this time, the applicant has earned sufficient points to be credited with a satisfactory year of Federal service for the R/R year 30 Apr 98 to 29 Apr 99. DP indicated that in accordance with the governing Air Force manual, a year of satisfactory Federal service for retirement is awarded when a member earns a minimum of 50 points in their full R/R year. After a careful review of the evidence of record, we note that, except for the retirement/retention period in question, the...

We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion of the Air Force office of primary responsibility that the applicant has not been the victim of an error or injustice as there is no evidence that he did not have sufficient opportunity during the 10 months after his assignment to the 37 th SFS to earn the additional 16 points he needed for a satisfactory year of service for RYE 9 January 2008.
