MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR 
SUBJECT : 

Having carefully reviewed this application, we agree with the 
recommendation of the Air Force office of primary responsibility 
and adopt the rationale expressed as the basis for our decision 
that the applicant has been the victim of either an error or an 
injustice.  Therefore, under the authority delegated in AFI 
3 6 - 2 6 0 3 ,   the applicant’s records will be corrected as set forth in 
the accompanying Memorandum for the Chief of Staff signed by the 
Executive Director of the Board or his designee.

The applicant, while serving in the grade of airman first class, was discharged fiom the Air 
Force 20 Jun 66 under the provisions of AFR 39-22 (Civil Court Conviction) and received an 
under other than honorable conditions discharge.  He served 04 years 11 months and 29 days total 
active service. 

Requested Action.  The applicant is requesting that his discharge be upgraded to at least a 

general. 

Basis for Request.  Applicant states he didn't realize that his discharge was as bad as it was.  He 

indicates he was told it was not a dishonorable and he did not realize how bad it was until he 
applied for VA benefits.  Applicant further states he attends church and he also helps umpire 
softball and he considers himself to be good citizen. 

Facts.  Applicant's master personnel record does not contain the discharge case file. However, 

based upon information in his application and his DD Form 214, we have determine that he was 
found guilty in civil court for first degree forgery for writing a $30.00 check on his roommates' 
checking account and was sentenced to one year probation.  Applicant states in his application, 
that he was not guilty because his roommate gave him permission to write the check and then it 
bounced for insufficient funds.  He indicates he appeared in court without an attorney. 

Recommendation.  Applicant had four years and 11 months honorable service prior to the 
incident which lead to his other than honorable conditions discharge.. In our review of the 
applicant's overall record, we would have has no objections to an upgrade of his discharge to 
under honorable conditions (general).  He has not filed a timely request.
