DEPARTMENT OF THE AIR FORCE

- WASHINGTON, DC

Office of the Assistant Secretary

AFBCMR
1535 Command Dr EE Wing 3rd Flr
Andrews AFB, MD 20762

Dear Colonel

Your application to the Air Force Board for Correction of

Military Records, AFBCMR Docket Number 98-00901, has been
finalized.

The Board determined that the military records should be

corrected as set forth in the attached copy of a Memorandum for
the Chief of Staff, United States Air Force. The office
responsible for making the correction(s) will inform you when
your records have been changed.

After correction, the records will be reviewed to determi-ne
if you are entitled to any monetary benefits as a result of the
correction of records. This determination is made by the Defense
Finance and Accounting Service (DFAS-DE), Denver, Colorado, and
involves the assembly and careful checking of finance records.
It may also be necessary for the DFAS-DE to communicate directly
with you to obtain additional information to ensure the proper
settlement of your claim. Because of the number and complexity
of claims workload, you should expect some delay. We assure you,
however, that every effort will be made to conclude this matter
at the earliest practical date.

Sincerely

b i e f Examiner

MEMORANDUM FOR AFBCMR

FROM: HQ AFPCDPSFC

550 C Street West, Ste 37
Randolph AFB TX 78 150-4739

SUBJECT: Application for Correction of Military Record

Requested Action and Basis for Request. Restore 4 days charged leave, 22 - 25 Jan 98

because applicant arrived at new duty location on 21 Jan 98 and did not take leave en route
between as si gnment s .

Facts and Discussion. Applicant departed Nellis AFB NV on 15 Jan 98 and arrived at

Langley AFB VA on 21 Jan 98. Supporting statements indicate finance charged applicant for 4
days leave following his arrival at Langley AFB VA. The Chief of Operations supports
applicant’s request for correction of his leave record. He states that applicant arrived at Langley
AFB on 21 Jan 98 and was available for duty but was at his on-base quarters receiving his
household goods. Because he in-processed at the Military Personnel Flight on 26 Jan 98, finance
allowed 7 days travel 19 - 25 Jan 98 and charged 4 days leave 15 - 18 Jan 98. In this case, we
support granting relief because he actually arrived and was available for duty on 21 Jan 98
although he in-processed on 26 Jan 98.

Recommendation. Restore 4 days to current leave account.

WILLIAM F. NADOLSKI, Major, USAF
Chief, Commanders’ Programs Branch

Restore 2 days charged leave for 25-26 Mar 98. When she reported in at the military personnel flight, finance allowed 3 days travel time 27 - 29 Mar 98 and charged 2 days leave, 25- 26 Mar 98. In this case, we support granting relief because the Air Force should not penalize the applicant for erroneous information received at the orderly room.

However, the law provides two mechanisms for changing spouse to former spouse coverage. If neither the member nor former spouse requests the election change within the one-year eligibility period, former spouse coverage may not be established thereafter. Discussion: Even though the member did not make a valid former spouse election change, there is no evidence he requested coverage for her be terminated.
