The Informal PEB (IPEB) found BPD unfitting and assigned a rating of 10%. CI’s CONTENTION : “The findings of the Physical Evaluation Board were that the unfitting condition was “bipolar disorder VA diagnostic code 9432” and it was rated at 10%. As noted above, the Navy PEB found the BPD unfitting, and assigned a disability rating of 10%.

The Informal PEB (IPEB) adjudicated the post-concussive syndrome and cervical dystonia condition as unfitting, rated 10%, respectively with application of the DoDI 1332.39 and Veterans’ Administration Schedule for Rating Disabilities (VASRD). According to the examiner, other than PTSD, there were no other mental symptoms. During the NP testing and psychiatry evaluation, the CI indicated that these symptoms were not functionally impairing and the CI did not seek or receive treatment for PTSD.

In the matter of the PTSD condition, the Board unanimously recommends by a vote of 2:1 a 10% permanent rating IAW VASRD §4.130. After consideration of all available evidence and mindful of VASRD §4.3 (reasonable doubt), this Board member recommends a permanent separation rating of 30% disability and retirement for the Posttraumatic Stress Disorder (PTSD) condition. The CI’s level of impairment did improve by the time of the TDRL evaluation on 11 May 2006.

The CI’s mental status exam (MSE) noted his mood was anxious, cognition was grossly intact with some decreased concentration, and he displayed an increased startle response.
