This is in reference to your application for correction of  you  naval  record pursuant to the 

provisions of  title  10 of  the United  States Code, section  155 a .

After careful and conscientious consideration of  the entire r&ord,  the Board  found  that the 
evidence submitted was  insufficient to establish the existence of  probable material error or 
injustice.  In  this connection, the Board  substantially concurred with  the comments contained in 
the advisory opinion.  Accordingly,  your application has been  denied.  The names and  votes of 
the members of  the panel  will be furnished upon  request. 

It is regretted that  the circumstances of  your case are such t  at favorable action cannot be  taken. 
You  are entitled to have the Board  reconsider  its decision u  n  submission of  new  and  material 
evidence or other matter not  previously considered by  the 
ard.  In  this regard, it is important 
to keep in  mind  that a presumption of  regularity attaches to

1.  In response to reference (a), recommen 
petitioner's request.

Petitioner's  EAOS at the time was 23 Apr 2p00 with an SEAOS of 23 
Apr 2001. 

-  Reference  (c), released on 30 Apr 9 9  with an effective date 

of 1 May 99 increased the zone "A"  SRB awapd level to 7.0 vice 
4.0 for the ET(14TO) rate/NEC 

-  Petitioner requests to expunge reenlistment date of 26 Apr 
99 and effect a reenlistment on 01 May 99 and receive the higher 
zone "A"  SRB entitlement in reference  (c). 

-  BUPERS/OPNAV cannot provide informatlion pertaining to 
subsequent SRB NAVADMIN's  until after the DAVADMIN has been 
released.  Therefore the petitioner could not have been counseled 
concerning reference  (c) prior to the ree listment.  Petitioner's 
hindsight is not sufficient grounds to ex unge the 26 Apr 99 
reenlistment as no error or injustice was 

2.  In view of the above, recommend petitioner's  record remain as 
1s. 

3.  This is an advisory memorandum to ref rence  (a) for use 
by the Board for Correction of Naval Reco ds  (BCNR) only.
