      After careful review of your application, military records and all
other available evidence, the Army Discharge Review Board determined that
you were properly and equitably discharged.  Accordingly, your request for
a change in the character and/or reason of your discharge is denied.

      You may reapply to the Army Discharge Review Board for a personal
appearance hearing and/or you may apply to the Army Board for Correction of
Military Records.  Enclosed are the necessary applications for requesting a
review from both boards.  If you choose to apply to the Army Board for
Correction of Military Records you must do so within three years from the
date of this letter.

      Be advised that the Army Discharge Review Board operates on a 15-year
statute of limitations from the date of discharge; therefore, you must
reapply within this time frame for a hearing.

                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 21 January 1999, the unit
commander in consultation with the Clinical Director/ADAPCP declared the
applicant a rehabilitation failure.  On 3 February 1999, the unit commander
notified the applicant of initiation of separation action under the
provisions of Chapter 9, AR 635-200, by reason of alcohol rehabilitation
failure, with an honorable discharge.  He was advised of his rights.  The
applicant consulted with legal counsel, was advised of the impact of the
discharge action, and did not submit a statement in his own behalf.  The
unit commander subsequently recommended separation from the service.  On 16
February 1999, the separation authority directed that the applicant be
discharged with a characterization of service of honorable.

      b.  On 24 February 1999, the applicant was discharged.  At the time
of discharge, the applicant had completed 3 months and 5 days of active
military service and accrued 6 days of lost time in the period under review
and had a total of 2 years, 9 months and 7 days of active military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 9 contains the authority and outlines the procedures for
discharging individuals because of alcohol or other drug abuse.  A member
who has been referred to the Alcohol and Drug Abuse Prevention and Control
Program (ADAPCP) for alcohol/drug abuse may be separated because of
inability or refusal to participate in, cooperate in, or successfully
complete such a program if there is a lack of potential for continued Army
service and rehabilitation efforts are no longer practical.  Army policy
states that an honorable or general discharge is authorized depending on
the applicant’s overall record of service.  (However, an honorable
discharge is required if restricted use information is used in the
discharge process).

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

                   Paragraph 1, above.

        (1)  The issue is rejected.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses.  The Board noted that the applicant was
enrolled in the Alcohol and Drug Abuse Prevention and Control Program
(ADAPCP) and was aware of the consequences of any action which would
demonstrate any inability or refusal to participate in, cooperate in, or
successfully complete such a program.  As a result of the applicant’s
actions and after consultation with the drug and alcohol abuse counselor,
the command declared the soldier a rehabilitation failure.  The evidence of
record establishes the fact that the applicant was properly counseled and
afforded a reasonable opportunity to overcome his problems.  The Board
found no evidence of arbitrary or capricious actions by the command.  The
Board was satisfied that all requirements of law and regulation were met
and the rights of the applicant were fully protected throughout the
separation process.  Individuals are assigned RE codes based on their
service records or the reason for discharge.  The applicant was
appropriately assigned an RE code of 4 because he was separated under the
provisions of AR 635-200, Chapter 9, by reason of alcohol rehabilitation
failure.  This Board found no bases upon which to change the applicant’s
reason for discharge.  An RE code of 4 indicates that the applicant was
separated from his last period of service with a disqualification which
cannot be waived and he is ineligible for reenlistment.  The Board noted
the applicant’s successful accomplishments since separation from active
duty.  However, these accomplishments do not provide the Board a basis upon
which to grant relief.  The Board, being convinced that the reason for
discharge was both proper and equitable, voted to deny relief.
