PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 27 September 2001 the unit commander in consultation with the Clinical Director/ADAPCP declared the applicant a rehabilitation failure. On 28 May 2002, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 9, AR 635-200, by reason of drug rehabilitation failure, with a general, under honorable conditions discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the service. On 3 June 2002 the intermediate commander recommended that the applicant’s separation be approved with a general, under honorable conditions discharge. On undated, the separation authority directed that the applicant be discharged with a characterization of service of general, under honorable conditions.

         b. On 3 July 2002, the applicant was discharged. At the time of discharge, the applicant had completed 3 years, 3 months, and 25 days of active military service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 9 contains the authority and outlines the procedures for discharging individuals because of alcohol or other drug abuse. A member who has been referred to the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) for alcohol/drug abuse may be separated because of inability or refusal to participate in, cooperate in, or successfully complete such a program if there is a lack of potential for continued Army service and rehabilitation efforts are no longer practical. Army policy states that an honorable or general discharge is authorized depending on the applicant’s overall record of service.

          a. Propriety:    The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.
(2) The issue is accepted. The Board noted from the evidence of record that the applicant was enrolled in ADAPCP in December 2000 and was declared an ADAPCP failure on 27 July 2001. The letter declaring the applicant an ADAPCP failure indicated that the applicant was disenrolled from the program and action to separate the applicant from service under the provisions of Chapter 9, AR 635-200, by reason of rehabilitation failure should be initiated within 60 days of the date of the letter. The evidence of record shows that recommended action was not taken and subsequently the applicant was promoted to the rank of private first class/E-3. On 26 February 2002 the applicant drove a vehicle under the influence of Alcohol. On 28 May 2002, almost 11 months after the applicant was disenrolled from ADAPCP and declared a rehabilitation failure, action was initiated to separate the applicant from service based on his ADAPCP failure on 27 July 2001. The Board determined that the applicant was no longer in the ADAPCP program and that the action to separate the applicant as a rehabilitation failure based on the 27 July 2001 declaration was improper. Accordingly, the Board voted to grant relief in the form of an upgrade of characterization of service to fully Honorable and a change to the narrative reason for separation to Secretarial Authority. This action does not entail a change to the reentry eligibility (RE) code.
