PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

          a. The evidence of record shows that on 4 December 1989, unit commander in consultation with the Clinical Director/ADAPCP declared the applicant a rehabilitation failure. On 2 January 1990, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 9, AR 635-200, alcohol abuse-rehabilitation failure, and his recommendation that he receive an honorable discharge. The applicant was advised of his rights, acknowledged notification, consulted with legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. The unit commander subsequently forwarded his recommendation for the applicant’s discharge; however, he changed his recommended type of discharge to general, under honorable conditions (GD). On 5 February 1990, the separation authority directed that the applicant be discharged with a GD.
         b. On 28 February 1990, the applicant was discharged with a GD. At the time of his discharge the applicant had completed 2 years, 7 months, and 15 days active military service.

         c. The record shows that the applicant had completed almost 3 years of service and had attained the rank of specialist/E-4. There are no documented acts of valor, significant achievement, or service warranting special recognition contained in the record. The applicant was enrolled in the Army Drug and Alcohol Prevention Control Program (ADAPCP) in June of 1989 following a DUI incident. After an initial period of success in the program the applicant again began drinking despite counseling that this type of behavior could result in his separation. On 12 November 1989 the applicant was apprehended for DUI and was found to have a blood alcohol level of .14. The unit commander in consultation with ADAPCP personnel declared the applicant a rehabilitation failure and processed him for separation. In his initial notification to the applicant the unit commander recommended an honorable discharge; however, changed this recommendation to a GD when he ultimately submitted the action.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 9 contains the authority and outlines the procedures for discharging individuals because of alcohol or other drug abuse. A member who has been referred to the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) for alcohol/drug abuse may be separated because of inability or refusal to participate in, cooperate in, or successfully complete such a program if there is a lack of potential for continued Army service and rehabilitation efforts are no longer practical. Army policy states that an honorable or general discharge is authorized depending on the applicant’s overall record of service. (However, an honorable discharge is required if restricted use information is used in the discharge process).

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

 (1) The issue is rejected. The Board noted the applicant’s contention that he had completed the primary leadership development course and it was not put in his records. However, this issue is not a matter on which the Army Discharge Review Board grants a change in discharge because it raises no matter of fact, law, procedure, or discretion relating to the discharge process nor is it associated with the discharge at the time of issuance. The record reflects that the applicant was enrolled in the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) and was aware of the consequences of any action which would demonstrate any inability or refusal to participate in, cooperate in, or successfully complete such a program. As a result of the applicant’s actions and after consultation with the drug and alcohol abuse counselor, the command declared the soldier a rehabilitation failure. The evidence of record establishes the fact that the applicant was properly counseled and afforded a reasonable opportunity to overcome his problems. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
