PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 17 December 1991, the unit commander in consultation with the Clinical Director/ADAPCP declared the applicant rehabilitation failure. On 21 January 1992, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 9, AR 635-200, alcohol abuse-rehabilitation failure, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, declined legal counsel, was advised of the impact of the discharge action, waived a hearing by a board of officers, and elected not to submit a statement in his own behalf. On 21 January 1992, the separation authority directed that the applicant be discharged with a GD.

         b. On 27 January 1992, the applicant was discharged with a GD. At the time of his discharge the applicant had completed 3 years and 6 months of active military service.

         c. The applicant’s record shows that he completed 3 and ½ years of his 4 year enlistment; that he attained the rank of specialist/E-4; that he served in Operation Dessert Storm, for which he earned the Southwest Asia Service Medal/with 2 bronze service stars. There is no indication of nonjudicial punishment or court-martial in the applicant’s record. On 10 October 1991, the applicant was enrolled the Army Drug and Alcohol Prevention Control Program (ADAPCP) based on his being involved in an alcohol related fighting incident. On 17 December 1991, a treatment synopsis memorandum pertaining to the applicant was prepared by ADAPCP personnel, on the request of the commander. In this report the applicant’s progress in the ADAPCP was rated as fair; however, based on the applicant’s admission that he used THC the unit commander declared him a rehabilitation failure. The unit commander processed the applicant for separation as an ADAPCP failure and recommended that he receive a GD.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 9 contains the authority and outlines the procedures for discharging individuals because of alcohol or other drug abuse. A member who has been referred to the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) for alcohol/drug abuse may be separated because of inability or refusal to participate in, cooperate in, or successfully complete such a program if there is a lack of potential for continued Army service and rehabilitation efforts are no longer practical. Army policy states that an honorable or general discharge is authorized depending on the applicant’s overall record of service. (However, an honorable discharge is required if restricted use information is used in the discharge process).

(2) The issue is accepted. There was a full consideration of all service including the infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board determined that the characterization of service was inequitable because the applicant's generally acceptable personal conduct and performance of duty mitigated the discrediting entries in his service record. Accordingly, the Board voted to grant relief in the form of an upgrade of characterization of service to fully honorable. The Board determined that the reason for discharge was proper and equitable and voted not to change it.
