PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 17 January 1991, the unit commander in consultation with the Clinical Director/ADAPCP declared the applicant rehabilitation failure. On 29 January 1991, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 9, AR 635-200, alcohol abuse rehabilitation failure, with a recommendation for an honorable discharge (HD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. On 7 February 1991, the Staff Judge Advocate determined that the separation action was legally sufficient. On 11 February 1991, the separation authority directed that the applicant be discharged with an HD.

         b. On 5 March 1991, the applicant was discharged with an HD. At the time of his discharge the applicant had completed 4 years, 1 month, and 2 days of active military service. DD Form 214 documents that the applicant was retained on active duty as essential to national security for 29 days, under the provisions of Title 10, 10 USC 673.

         c. The applicant’s record shows that he completed over 4 years of service; attained the rank of specialist/E-4; completed an overseas tour in Korea; and earned a Good Conduct Medal and the Overseas Service Ribbon. The applicant was enrolled in the Army Drug and Alcohol Prevention Control Program on 9 May 1990 due to excessive use of alcohol. On 29 January 1991, after consultation with ADAPCP personnel, the unit commander declared the applicant a rehabilitation failure and processed him for separation, citing the applicant’s lack of motivation to participate in ADAPCP as the basis for taking the action.

 2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 9 contains the authority and outlines the procedures for discharging individuals because of alcohol or other drug abuse. A member who has been referred to the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) for alcohol/drug abuse may be separated because of inability or refusal to participate in, cooperate in, or successfully complete such a program if there is a lack of potential for continued Army service and rehabilitation efforts are no longer practical. Army policy states that an honorable or general discharge is authorized depending on the applicant’s overall record of service. (However, an honorable discharge is required if restricted use information is used in the discharge process).

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

 (1) The issue is rejected. The Board noted the applicant’s contention that, in effect, his discharge was unfair because the ADAPCP treatment plan was excessive and he had already completed his enlistment and was held due to stop loss based on the Gulf War. However, the Board noted that the applicant was enrolled in the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) and was aware of the consequences of any action which would demonstrate any inability or refusal to participate in, cooperate in, or successfully complete such a program. As a result of the applicant’s actions and after consultation with the drug and alcohol abuse counselor, the command declared the soldier a rehabilitation failure. The evidence of record establishes the fact that the applicant was properly counseled and afforded a reasonable opportunity to overcome his problems. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
