PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 4 March 1994, the unit commander in consultation with the Clinical Director/ADAPCP declared the applicant rehabilitation failure. On 6 April 1994, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 9, AR 635-200, alcohol rehabilitation failure, with an honorable (HD) discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement on his behalf. The unit commander subsequently recommended approval of the discharge action and forwarded it through command channels to the separation authority and recommended approval with an HD. On undated, the separation authority directed that the applicant be discharged with an HD.

         b. On 27 May 1994, the applicant was discharged with an honorable discharge, under the provisions of Chapter 9, AR 635-200, by reason of alcohol rehabilitation failure. He was credited with 1 year, 2 months, and 25 days active service on the enlistment under review.

         c. The applicant’s record shows that he completed a little over a year in service and the highest rank he attained while on active duty was private first class/E-3. There are no documented acts of valor, significant achievement, or service warranting special recognition contained in the record. The applicant was enrolled in the Army Drug and Alcohol Prevention Control Program (ADAPCP) for alcohol rehabilitation. On 4 March 1994 the ADAPCP clinical director prepared a memorandum in which he recommended that the applicant be declared a rehabilitation failure because further rehabilitation was not practical. The unit commander after consultation with ADAPCP personnel declared the applicant a rehabilitation failure and processed him for discharge, under the provisions of chapter 9, AR 635-200.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 9 contains the authority and outlines the procedures for discharging individuals because of alcohol or other drug abuse. A member who has been referred to the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) for alcohol/drug abuse may be separated because of inability or refusal to participate in, cooperate in, or successfully complete such a program if there is a lack of potential for continued Army service and rehabilitation efforts are no longer practical. Army policy states that an honorable or general discharge is authorized depending on the applicant’s overall record of service. (However, an honorable discharge is required if restricted use information is used in the discharge process).

         a. Propriety:    The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is rejected. The Board noted the applicant’s contention that, in effect, his discharge and bar to reenlistment were improper because a relapse is part of the normal recovery process; and that, based on suggestions from his Army ADAPCP counselors, he has attained five years of sobriety. However, the Board noted that the applicant was enrolled in the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) and was aware of the consequences of any action which would demonstrate any inability or refusal to participate in, cooperate in, or successfully complete such a program. As a result of the applicant’s actions and after consultation with the drug and alcohol abuse counselor, the command declared the soldier a rehabilitation failure. The evidence of record establishes the fact that the applicant was properly counseled and afforded a reasonable opportunity to overcome his problems. Further, changing an applicant’s RE code is not within the purview of the Army Discharge Review Board (ADRB). However, the Board did conclude that the RE code of
4, assigned the applicant at discharge, was in accordance with applicable regulations based on the reason for his separation. The Board, being convinced that the reason for discharge was both proper and equitable, voted to deny relief.


         b. Equity:       The applicant has not submitted an issue of equity and the ADRB has not otherwise relied upon an issue of equity to change the discharge. The major factors upon which the discharge was based are set forth in Parts III and IV of this decisional document.
