PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 9 April 1986, the unit commander in consultation with the Clinical Director/ADAPCP, declared the applicant a rehabilitation failure. On 10 April 1986, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 9, AR 635-200, by reason of drug abuse-rehabilitation failure, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. The separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 15 April 1986, the applicant was discharged with a GD. At the time of discharge, the applicant had competed 3 years, 9 months, and 17 days of active military service.

         c. The applicant’s record shows that he was 2 months and 14 days short of completing his 4 year enlistment at the time of his separation; that the highest rank he held on active duty was specialist/E-4; and that he completed an overseas tour in Germany for which he earned the Overseas Service Ribbon. His disciplinary record includes his acceptance of an Article 15 on 4 November 1985, for the wrongful use of marijuana which resulted in his being reduced to private/E-1. The applicant had participated in Track 1 of the Army Drug and Alcohol Abuse Prevention Control Program (ADAPCP) on 7 and 14 December 1985 and was terminated based on his successful completion of the program requirements. He again tested positive for marijuana use in March 1986 and was declared an ADAPCP rehabilitation failure by his unit commander in consultation with the ADAPCP clinical director.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 9 contains the authority and outlines the procedures for discharging individuals because of alcohol or other drug abuse. A member who has been referred to the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) for alcohol/drug abuse may be separated because of inability or refusal to participate in, cooperate in, or successfully complete such a program if there is a lack of potential for continued Army service and rehabilitation efforts are no longer practical. Army policy states that an honorable or general discharge is authorized depending on the applicant’s overall record of service. (However, an honorable discharge is required if restricted use information is used in the discharge process).

(2) The issue is accepted. The Board noted that the applicant was erroneously discharged under the provisions of Chapter 9, AR 635-200 by reason of being an Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) rehabilitation failure. The evidence of record shows that the applicant had successfully completed Track 1 of ADAPCP prior to the events which led to his discharge, and that he was not enrolled in the program at the time he was declared a rehabilitation failure. Therefore, the Board concluded that the applicant’s discharge was improper. Accordingly, the Board voted to upgrade the characterization of the service to fully honorable, and to change the reason for discharge to Secretarial Authority.
