PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 20 April 1993, the unit commander in consultation with the Clinical Director/ADAPCP declared the applicant rehabilitation failure. On 30 April 1993, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 9, AR 635-200 and drug abuse rehabilitation failure, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, declined legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. On 5 May 1993, the Judge Advocate determined the separation action was legally sufficient. The approved the separation action and directed the applicant be discharged with a GD.

         b. On 24 June 1993, the applicant was discharged with a GD. At the time of his discharge the applicant had completed 8 months and 23 days of his current enlistment, and a total of 4 years, 2 months and 29 days of active military service.

         c. The applicant’s record shows that he completed over 4 years of service; attained the rank of specialist/E4; and earned the two Army Achievement Medals, and the Overseas Ribbon for completing a tour in Germany. His disciplinary record for the period of enlistment under review includes his acceptance of an Article 15 on 10 June 1993, for being AWOL from 12 to 21 May 1993. His punishment for this offense included a reduction to private first class/E-3. The applicant was enrolled in the Army Drug and Alcohol Prevention and Control Program (ADAPCP) on 9 December 1992. On 20 April 1993, the applicant’s unit commander declared him an ADAPCP rehabilitation failure, citing that the applicant had tested positive for cocaine in a weekly urine sample given on 6 January 1993, as part of his ADAPCP requirements. On 30 April 1993, the unit commander initiated separation action on the applicant, under the provisions of Chapter 9, AR 635-200 by reason of ADAPCP rehabilitation failure.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 9 contains the authority and outlines the procedures for discharging individuals because of alcohol or other drug abuse. A member who has been referred to the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) for alcohol/drug abuse may be separated because of inability or refusal to participate in, cooperate in, or successfully complete such a program if there is a lack of potential for continued Army service and rehabilitation efforts are no longer practical. Army policy states that an honorable or general discharge is authorized depending on the applicant’s overall record of service. (However, an honorable discharge is required if restricted use information is used in the discharge process).

(2) The issue is accepted. The Board noted that the government introduced a document into the discharge process revealing that the applicant had self-referred to the Alcohol and Drug Prevention and Control Program for substance abuse and that he had tested positive for drug use while participating in the program. This is limited use information as defined in Chapter 6, AR 600-85. Use of this information mandates award of a fully honorable discharge. Accordingly, the Board voted to change the characterization of service to fully honorable. However, the board found that the reason for discharge was fully supported by the record and voted not to change it.
