PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 4 January 1993, the unit commander in consultation with the Clinical Director/ADAPCP declared the applicant rehabilitation failure. On 1 February 1993, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 9, AR 635-200, alcohol rehabilitation failure, with an unclear characterization of service recommendation. The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. The separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a general, under honorable conditions discharge (GD).

         b. On 24 April 1993, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 3 years, 9 months service of his current enlistment and a total of 6 years, 8 months, and 28 days of active military service.

         c. The applicant’s record shows that he had completed almost 7 years of service; had attained the rank of specialist/E-4; completed overseas tours in Germany and Korea; served in combat during Operation Desert Storm; and earned an Army Commendation Medal, two Good Conduct Medals, the Southwest Asia Service Medal/w 2 bronze service stars, and the Kuwait Liberation Medal. The applicant’s disciplinary history includes his acceptance of an Article 15 on 4 March 1992, summarized, for conducting himself in a disorderly manner; for writing on the floor; and for conducting himself in a nature to bring discredit upon the armed forces. The applicant was enrolled in the Army Drug and Alcohol Prevention Control Program (ADAPCP) on 2 March 1992 for alcohol abuse, and was declared a rehabilitation failure by his unit commander on 1 February 1993. The commander cited the applicant’s involvement in two alcohol related incidents between 10 and 22 December 1992 as the basis for taking the action.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 9 contains the authority and outlines the procedures for discharging individuals because of alcohol or other drug abuse. A member who has been referred to the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) for alcohol/drug abuse may be separated because of inability or refusal to participate in, cooperate in, or successfully complete such a program if there is a lack of potential for continued Army service and rehabilitation efforts are no longer practical. Army policy states that an honorable or general discharge is authorized depending on the applicant’s overall record of service. (However, an honorable discharge is required if restricted use information is used in the discharge process).

 (2) The issue is accepted. There was a full consideration of all service including the infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board determined that the characterization of service was inequitable because the applicant's generally acceptable personal conduct and performance of duty mitigated his misconduct. Accordingly, the Board voted to grant relief in the form of an upgrade of characterization of service to fully honorable. The Board determined that the reason for discharge was proper and equitable and voted not to change it.
