THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his Official Military Personnel File (OMPF) on the integrated Personnel Electronic Records Management System (iPERMS) be corrected by removing duplicate orders concerning his first award of the Army Good Conduct Medal.

2.  The applicant states he was submitted twice for his first award of the Army Good Conduct Medal.

3.  The applicant provides, in support of his application, Permanent Orders 
071-022, dated 12 March 2001, and Permanent Order 039-04, dated 8 February 2002, both awarding him the Army Good Conduct Medal (1st Award).  

CONSIDERATION OF EVIDENCE:

1.  The applicant's military personnel records show he enlisted in the Regular Army on 13 November 1997 and he reenlisted on 14 February 2002 and 
22 February 2006.  He is currently serving on active duty.

2.  Bravo Detachment, 4th Personnel Services Battalion, Fort Carson, CO, Permanent Orders 071-022, dated 12 March 2001, awarded the applicant the  
Army Good Conduct Medal (1st Award) for the period from 13 November 1997 to 12 November 2000.

3.  Permanent Order 039-04 published by the 148th Military Police Detachment, Fort Carson, CO, dated 8 February 2002, awarded the applicant the Army Good Conduct Medal (1st Award) for the period from 13 November 1997 to 
12 November 2000.

4.  Company A, 701st Military Police Battalion, Fort Leonard Wood, MO, Permanent Order 362-01, dated 28 December 2005, awarded the applicant the Army Good Conduct Medal (2nd Award) for the period from 13 November 2000 to 12 November 2003.

5.  Permanent Orders 106-01 published by the 701st Military Police Battalion, Fort Leonard Wood, MO, dated 16 April 2007, awarded the applicant the Army Good Conduct Medal (3rd Award) for the period from 13 November 2003 to 
12 November 2006.

6.  Army Regulation 600-8-104 (Military Personnel Information Management/ Records), provides in Table 2-1 (Composition of the OMPF) provides that award orders are filed in the Commendatory and Disciplinary portion of the OMPF.  This regulation also provides that once filed such documents become a permanent part of the OMPF and may only be removed by one of several agencies, one of which is the Army Board for Correction of Military Records (ABCMR).

DISCUSSION AND CONCLUSIONS:

1.  Permanent Order 039-04, dated 8 February 2002, duplicated a previously issued award; therefore, it is clearly in error.  The applicant's 1st award of the Army Good Conduct Medal had previously been issued by Permanent Orders 071-022, dated 12 March 2001.  Therefore, it would be appropriate to revoke Permanent Order 039-04, dated 8 February 2002.  

2.  Permanent Order 039-04, dated 8 February 2002, was the result of an administrative error.  This order holds no historical value in documenting the applicant's military career.  Therefore, it would be appropriate to remove this order and the revocation from the applicant's OMPF.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a.  revoking Permanent Order 039-04, dated 8 February 2002; and 

	b.  removing Permanent Order 039-04, dated 8 February 2002, from, and ensuring the revocation order is not filed in, the applicant's OMPF.
