The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion, if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that duplicate orders awarding him the Army Good Conduct Medal be removed from his official military personnel File (OMPF).
2. The applicant states that there are two sets of orders awarding him the Army Good Conduct Medal for the same period of service.
3. The applicant provides copies of Permanent Orders 232-00013, United States Army Armor Center and Fort Knox, Fort Knox, Kentucky, dated 20 August 2001; Permanent Orders 022-00003, United States Army Armor Center and Fort Knox, Fort Knox, Kentucky, dated 22 January 2002; and Permanent Orders 092-00033, United States Army Armor Center and Fort Knox, Fort Knox, Kentucky, dated
2 April 2002.
CONSIDERATION OF EVIDENCE:
1. The applicant, at the time of his application, was serving on active duty in the Regular Army, in the rank of staff sergeant, pay grade E6.
2. Permanent Orders 232-00013, United States Army Armor Center and Fort Knox, Fort Knox, Kentucky, dated 20 August 2001, awarded the applicant the Army Good Conduct Medal for the period from 30 October 1998 to 29 October 2001.
3. Permanent Orders 022-00003, United States Army Armor Center and Fort Knox, Fort Knox, Kentucky, dated 22 January 2002, awarded the applicant the Army Good Conduct Medal for the period from 30 October 1998 to 29 October 2001.
4. Permanent Orders 092-00033, United States Army Armor Center and Fort Knox, Fort Knox, Kentucky, dated 2 April 2002, revoked Permanent Orders 022-00003, United States Army Armor Center and Fort Knox, Fort Knox, Kentucky, dated 22 January 2002.
5. Army Regulation 600-8-104 (Military Personnel Information Management/Records) provides, in pertinent part, that once a document is placed in the official military personnel file, it becomes a permanent part of that file. The document will not be removed from the fiche or moved to another part of the fiche unless directed by The Army Board for Correction of Military Records.
6. Army Regulation 600-8-22 provides that the Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified. Current practice requires that the commander provide written notice of unfavorable consideration and permits the individual to respond.
DISCUSSION AND CONCLUSIONS:
1. The applicant's records show that the United States Army Armor Center published two sets of orders awarding the applicant the Army Good Conduct Medal for the same period of service. Subsequently, the second set of orders was revoked.
2. The Army has an interest in maintaining the accuracy of its records. It is also important that these records be as concise as possible to help preclude misinterpretation by individuals or boards during their review of these records. Hence, it would be prudent to remove the duplicate set of award orders and its revocation.
3. Therefore, Permanent Orders 022-00003, dated 22 January 2002; and Permanent Orders 092-00033, dated 2 April 2002, should be removed from the applicant's OMPF.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant a recommendation for relief and to excuse failure to timely file. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by removing Permanent Orders 022-00003, dated
22 January 2002; and Permanent Orders 092-00033, dated 2 April 2002, from the applicant's OMPF.

The applicant states, in effect, that a duplicate order awarding him the Good Conduct Medal (Fourth Award) and the corresponding order revoking that order are filed in the performance section of his OMPF and this may give members of a future Command Sergeants Major promotion selection board a false impression that the award was actually taken away from the applicant. The evidence of record confirms that the applicant was properly awarded the Good Conduct Medal (Fourth Award) by permanent...

The applicant states that his OMPF has 5 different orders for his AGCM (4th Award) and he requests that 4 of the awards be removed from his OMPF. These orders awarded the applicant the AGCM (4th Award) for the period 29 January 1997 to 28 January 2000. Orders awarding the applicant the AGCM (1st through 3rd Award) are correct for those time periods in which the applicant served.

The applicant requests that his records be corrected by removing duplicate orders authorizing award of the third and fourth Good Conduct Medals and the revocation orders for these duplicate orders. However, the retention of the duplicate orders for the awards and the orders revoking those orders in his permanent file might create an illusion that something improper occurred or result in confusion as to correct periods and dates of award of the Good Conduct Medals. The Board further...

The applicant requests that a record of nonjudicial punishment (Article 15) and a service school academic evaluation report (AER) be expunged from his OMPF (Official Military Personnel File). Once placed in the OMPF, the document becomes a permanent part of that file and will not be removed from a fiche or moved to another part of the fiche unless directed by certain agencies, to include the Army Board for Correction of Military Records (ABCMR). The applicant continues that a memorandum for the disqualification of the first award for the Army Good Conduct Medal was erroneously filed in his MPRJ (Military Personnel Jacket Record) and in the performance section of his OMPF.
