THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests: deletion of Permanent Orders 326-31, dated 22 November 1999, awarding the 1st Army Good Conduct Medal; and deletion of Permanent Order 324-04, dated 19 November 2008, awarding the 3rd Army Good Conduct Medal, from his OMPF.
2. The applicant states Permanent Orders 326-31 duplicates the action of awarding his first Army Good Conduct Medal which was accomplished by Permanent Orders 287-63, dated 14 October 1999. He states that there are two versions of Permanent Order 324-04, dated 19 November 2008, in his OMPF; one incorrectly awards a 3rd Army Good Conduct Medal and the other correctly awards a 4th Army Good Conduct Medal.
3. The applicant provides a copy of an electronic mail.
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the Regular Army for 3 years on 4 September 1996. He continues to serve on active duty in the rank of Sergeant First Class (SFC/E-7).
2. On 14 October 1999, Permanent Orders 287-63, Headquarters, US Army Artillery Center and Fort Sill, Fort Sill, OK awarded him the first Army Good Conduct Medal for the period 4 September 1996 through 3 September 1999. On 22 November 1999, the same headquarters published Permanent Orders 326-31 accomplishing the same thing.
3. On 19 November 2008, Headquarters and Headquarters Company, 505th Quartermaster Battalion, published two versions of Permanent Order 324-04. One version awarded him the 3rd award of the Army Good Conduct Medal; the other version awarded him the 4th award of the Army Good Conduct Medal.
4. The applicant's periods of service for award of the Army Good Conduct Medal as shown on orders are:
1st Award 19960904 19990903
2nd Award 19990906 20020905
3rd Award 20021016 20051015
4th Award 20051015 20081014
5. There is no evidence of record to show the applicant was ever disqualified for award of the Army Good Conduct Medal.
6. Army Regulation 600-8-22 (Military Awards) provides that the Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified.
DISCUSSION AND CONCLUSIONS:
1. The applicant requests that two permanent orders involving award of the Army Good Conduct Medal be deleted from his OMPF because they are duplicates.
2. Army Good Conduct Medals are issued for 3-year periods commencing on the date of enlistment on active duty. The orders awarding the applicant's first Army Good Conduct Medal are the only correct orders in his OMPF; all subsequent orders are incorrect as to the periods of service.
3. The applicant's periods of service for award of the Army Good Conduct Medal should be as follows:
1st Award 19960904 19990903
2nd Award 19990904 20020903
3rd Award 20020904 20050903
4th Award 20050904 20080903
4. Only the October 1999 orders awarding him the first award of the Army Good Conduct Medal is correct. Therefore, his OMPF should be corrected as indicated below.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:
a. revoking and removing the following orders:
(1) Permanent Orders 326-31, Headquarters, US Army Artillery Center and Fort Sill, Fort Sill, OK, dated 22 November 1999;
(2) Permanent Orders 266-002, Headquarters, US Army Artillery Center and Fort Sill, Fort Sill, OK, dated 23 September 2002;
(3) Permanent Order 324-04, Headquarters and Headquarters Company, 505th Quartermaster Battalion, Unit 35130, dated 19 November 2008 (awarding the 3rd award of the Army Good Conduct Medal);
(4) Permanent Order 324-04, Headquarters and Headquarters Company, 505th Quartermaster Battalion, Unit 35130, dated 19 November 2008 (awarding the 4rd award of the Army Good Conduct Medal); and
(5) Permanent Order 305-01, Headquarters and Headquarters Company, 505th Quartermaster Battalion, Unit 35130, dated 20 July 2009;
b. not filing the revocation order(s) in the individual's OMPF; and
c. issuing a new order awarding the Army Good Conduct Medal to the individual concerned for the following periods:
(1) 2nd award 19990904 20020903;
(2) 3rd award 20020904 20050903; and
(3) 4th award 20050904 20080903.
