THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, removal of Permanent Orders 26-226, dated 26 January 2002, and Permanent Orders 163-01, dated 12 June 2006, from her Official Military Personnel File (OMPF). 2. The applicant states, in effect, the subject orders awarding her the Army Good Conduct Medal - first and second awards - are incorrect as to the dates or period of service, and she has correct orders in her records for these awards. 3. The applicant provides A Detachment, 516th Personnel Services Battalion Permanent Orders 26-226, dated 26 January 2002; and Headquarters and Headquarters Company, 1st Brigade, 3rd Infantry Division, Fort Stewart, GA, Permanent Orders 163-01, dated 12 June 2006, in support of her request. CONSIDERATION OF EVIDENCE: 1. The applicant’s records show she enlisted in the Regular Army (RA) on 26 May 1998 and she continues to serve on active duty. 2. The applicant’s OMPF contains the following sequential orders awarding her the Army Good Conduct Medal: a. Headquarters, 101st Airborne Division (Air Assault), Fort Campbell, KY, Permanent Orders 131-00058, dated 11 May 2001, awarding her the Army Good Conduct Medal for the period 26 May 1998 through 25 May 2001; b. Headquarters, 3rd Soldier Support Battalion (Provisional), Camp Liberty, Kuwait, Permanent Orders 262-05, dated 13 April 2005, awarding her the Army Good Conduct Medal (2nd Award) for the period 26 May 2001 through 25 May 2004; and c. Headquarters, Task Force 2-7, 1st Heavy Brigade Combat Team, 3rd Infantry Division, Fort Stewart, Permanent Orders 323-01, dated 19 November 2009, awarding her the Army Good Conduct Medal (3rd Award) for the period 26 May 2004 through 25 May 2007. 3. A Detachment, 516th Personnel Services Battalion, Permanent Orders 26-226, awarded the applicant the Army Good Conduct Medal (1st Award) for the period 27 May 1998 to 26 May 2001. These orders cite an incorrect period of service and duplicates correct orders shown in paragraph 2a, above. 4. Headquarters and Headquarters Company, 1st Brigade, 3rd Infantry Division, Fort Stewart, Permanent Orders 163-01, awarded the applicant the Army Good Conduct Medal (2nd Award) for the period 25 May 2003 through 26 May 2006. These orders cite an incorrect period of service and duplicates correct orders shown in paragraph 2b, above. 5. Army Regulation 600-8-22 (Military Awards) provides that the Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. Although there is no automatic entitlement to the Good Conduct Medal, disqualification must be justified. DISCUSSION AND CONCLUSIONS: The subject orders are incorrect as to dates and/or periods of service, and duplicate correct orders previously published. Therefore, these incorrect orders should be removed from the applicant's OMPF.
