	The Board considered the following evidence:

	Exhibit A - Application for correction of military records.

	Exhibit B - Military Personnel Records (including advisory opinion, if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that her records be corrected by removing from her Official Military Personnel File (OMPF), Permanent Order Number 79-7, a duplicate copy of DA Form 2173 (Statement of Medical Examination and Duty Status), and a single page University of Maryland University College transcript. 

2.  The applicant states, in effect, that her military service records are in error because it contains erroneous information that pertains to her Army Good Conduct Medal (AGCM).  Her records were corrected three times already.  A DA Form 2173 was submitted in a hasty manner and it has conflicting information when compared to the other completed DA Form 2173 that is filed in the restricted section of the OMPF.  She further states, in effect, that her individual college transcript credit is reflected in a four page college transcripts, so she would like to have the individual college transcript remove from her OMPF.

3.  The applicant provides two copies of Permanent Orders Number 79-7, dated 20 March 2006; a copy of Permanent Order Number 254-3, dated 11 September 2006; Permanent Order Number 254-4, dated 11 September 2006; a single page University of Maryland University College transcript; and four copies of an official transcript from the same university.

CONSIDERATION OF EVIDENCE:

1.  The applicant's military service records show that she is currently assigned to the United States Army Element, Defense Information Agency, A Company, 302nd Signal Battalion, 21st Signal Brigade, Fort Detrick, Maryland.

2.  The applicant was awarded the AGCM for the period 20 May 2003 to 19 May 2006 (6th Award) on Permanent Orders Number 254-4 dated 11 September 2006.

2.  A review of the applicant's OMPF does not show a copy of Permanent Order Number 79-7.  However, it does show an incomplete copy of a DA Form  
2173 filed in the service and medical section of her OMPF, a single page University of Maryland University College transcript, and a Northern Virginia Community College transcript.

3.  Army Regulation 600-8-104 (Military Personnel Information Management/
Records) prescribes the policies governing the Official Military Personnel File, the Military Personnel Records Jacket (MPRJ), the Career Management Individual File, and Army Personnel Qualification Records.  Paragraph 2-4 of this regulation states that once a document is placed in the OMPF it becomes a permanent part of that file and will not be removed from that file or moved to another part of the file unless directed by the proper authorities listed in the regulation.  Table 2 of the regulation pertains to the composition of the OMPF.

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that her records should be corrected by removing from her OMPF Permanent Order Number 79-7, a duplicate copy of DA Form 2173, and a single page University of Maryland University College transcript.

2.  However, the only contested document contained in her OMPF is the incomplete copy of a DA Form 2173 filed in the service and medical section of the OMPF.  Since a complete copy of the DA Form 2173 is also contained in her OMPF, the incomplete DA Form 2173 can be confusing.  As such, it would be in the interest of justice to correct her records by removing the incomplete DA Form 2173 from the service and medical section of her OMPF.

3.  Permanent Order Number 254-4, dated 11 September 2006 was appropriately published for the AGCM (6th Award) and was filed in her OMPF.  There is no Permanent Order Number 79-7, dated 20 March 2006 filed in her OMPF.

4.  The single page University of Maryland University College transcript contains college credits that were transferred to Northern Virginia Community College’s official transcript.  Therefore, there is no basis to remove that document from the applicant's OMPF.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by removing the incomplete DA Form 2173 from the service and medical section of the applicant's OMPF.

2.  The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to removal of the single page University of Maryland University College transcript; and removal of Permanent Orders 79-7, which is not contained in the applicant’s OMPF.
